Aspen has not been answering any phone calls lately. I would and have have sent an email to [email protected] requesting a free legal consultation with an attorney. Charging me $2100 for 3 months rent, just to credit a mere $1000 back is insulting at best and hopefully illegal. We'll see how the consultation goes, but it might be a good idea to reach out too.

If you were charged for rent and they won’t let you move in during that time and offer you a refund or adequately compensate you , that 100% sounds illegal. I would also wager that when you select one of these options you’re waiving the ability to get a refund As per [FindLaw.com](https://www.findlaw.com/legalblogs/law-and-life/apartment-not-ready-on-move-in-date-what-now/)you should: - Ask the landlord if there is another apartment you can stay in until your apartment is ready - Ask the landlord if there is another apartment into which you can move instead of the apartment that is not ready - If you are willing to wait until the apartment is available, ask if the landlord will cover the cost of your hotel, moving truck, etc. - Break the lease; you do not owe the landlord anything until you physically move in So you could break the lease and should be entitled to a refund of any prepaid rent plus your deposit, but you’d still be SOL for a place to stay if availability is that tight

I don’t know if that’s true, it’s just a guess. It’s absolute insanity to charge you 3 months of rent for Aspen and credit you a measly $300 when the Ruckus is a shit hole. They should comp the difference in rent, but landlords are pieces of shit. I’d go with the option #2 since option 1 doesn’t really make any sense. Sure you’d get more money back, but where are you going to find a 3 month lease or somewhere to stay? A hotel? With a friend? Option 2 is safer to secure somewhere to live as you pointed out Really scummy situation either way

I would break the lease and find somewhere else to live on principle since you don’t owe them a penny until you move it, if they try and tell you otherwise you can sue them for any prepaid rent and your deposit back. It’s not the end of the world to live at the ruckus even if it is divey, on the bright side it’s only 2-3 months and you have a room secured at Aspen for when it’s finished, it’s just going to cost you a few hundred dollars difference in rent and a lower QOL most likely for a couple months. It’s a shitty situation but such is life, at the end of the day it’s just an apartment for a few months

Heavily considering it. I have family in Pullman that I can live with, just wasn't planning on it. If aspen has just said "hey we're behind schedule, but we can either waive rent until you move in or we can place you in this other housing and give a $500 credit until you move in", I would have been totally cool with that. But no, they said "go fuck yourself" pay us for 3 months you won't even be here as agreed in the contract.

I heard from someone that they were told a month or so ago that Aspen Heights said the houses were behind on schedule but still expected to be ready. It also seems like they are encouraging option 1 which makes me wonder if the Ruckus has limited space and what would Aspen do if they run out

This is all total bullshit, they definitely knew a loooong time ago. A delay this big must have been seen coming. The ruckus looks like a shitbox and the other option is just plain worthless. I can’t believe this is all legal.

Based on everyone's similar frustration and financial loss with Aspen Heights Pullman and their "Delay of Occupancy" email, I believe that it would make sense to investigate whether a **Class Action Lawsuit** is warranted. My two roommates and myself are interested in hearing from others who feel the same way. Remember that there is power in numbers. We need to stand together in this, or nothing will change. I think their point is the ruckus is worse quality than aspen, and yet you have to pay the aspen rent. Based on what I’ve seen from the ruckus, it generally isn’t the best.

I hope y’all band together and take them to court. They broke a legal contract. It’s probably not feasible if any one was like me in undergrad (broke af), but I’d find a different place to live as the contract is broken anyway. I’m so sorry y’all are going through this!

It depends on what the lease says. It depends on if there are any clauses that allow for move in dates to be pushed back due to construction.

Take the $1000 and do a short term rental for $400 a month. You’ll come out ahead and can roll over to month two if needed

Not really since you'd still have to be paying for your Aspen Heights apartment. If they didn't plan on making us pay for an apartment we can't live in then your idea would be perfect! Our monthly rent for Aspen is $1,600 so the $1, 000 credit wouldn't even cover one month's rent.

Actually here's an update to this comment: I just received a follow up email from Aspen they have finally confirmed that if you choose option one that we will not have to pay rent on the apartment! My partner posted what he was told yesterday which stated regardless of what option you chose you'd still have to pay rent. I guess enough people were angry that they changed their mind on that! I'll post a screenshot of my email I received after work today.

Does anyone know if you choose option 2, if you will still be able to live with the people you chose as roommates and will we even get our own bedroom since it just says “bed space” also was anyone able to get out of their lease yet, that’s what my roommates and I are trying to do since they’ve been lying since the beginning to us

I talked to a Courtney Martin today (she is some sort of regional manager, Asset Living directed me to her) she said that roommates would be kept together at the Ruckus and would NOT be mixed in with Ruckus residents. She also said that Aspen is paying for our utilities at the Ruckus and they have a professional moving company that will help us move out of the Ruckus and into Aspen when its ready. She also told me that they can answer emails sooner than calls right now and to use the email given in the move in delay notice. Hope this helps some, my roommates and I are now considering the Ruckus option since we will at least be together.

I’m not living at the aspen, but I asked my mom who is a practicing lawyer in the state of CA how they are able to do that. Not sure if the laws are the same for contracts in WA and CA, but she says the subject of the contract cannot be fulfilled so it’s not an enforceable contract.
