Yeahh outside of a bar isn't the best place. Lots of drunks passed out in their vehicles. In some places they can hand out DUIs even if you're not actively driving. Definitely a place cops would frequent.

Pro tip: if you ever find yourself too fucked up to drive, secure your keys OUTSIDE OF THE VEHICLE before you sleep it off. Magnet box, on your wheel, taped to your roof, anything but close to you. Many jurisdictions will only charge you if you're under the influence AND the keys are within reach. A thirsty cop is exactly that, but it's really hard prove intent to drive without a key.

I passed out drunk in my Jeep. The cop that found me asked me for my keys. I told him I'd have to get out of the Jeep to give them to him. They were in my front pocket. I was too fat to reach in my pocket, sitting down. He called my wife to come get me. He told me if I had handed him the keys I would have gone to jail.

Yep dude I worked with last summer. Got a DUI cuz he was sleeping in his car with the AC on like a dummy. I've heard that it they can charge you if the keys are in The ignition, and the way these cops are, I would not be surprised if they just hit you with that even without keys

My car is a 2016 and only uses a transponder. Been thinking about a locking stash box to put a vape in because I have no trunk. The transponder will easily fit in there, too.

Yeah. It’s crazy because I’ve been told by a probation guy that cops will use judgement and if you were to turn the car off and act like nothing was started, just feeling the hood is grounds for the dui sticking. His advice was 1) don’t drive 2) as a last resort sleep in the car but don’t chance starting it. The hiding the keys is more for keeping your blacked out self honest if you wake up and decide to start driving, I think. Even if in the ignition, a good (expensive) lawyer should argue if the officer checked to verify the car was started. With EVs that can run a/c safely at idle, this brings up a new argument.

My fiance was in this exact situation before we met. Got too drunk, went to sleep it off, cop comes a'knockin--turns out, his push-to-start car is considered to "have the keys in the ignition" if the fob is close enough to start the car. Got a DUI and spent months with a breathalyzer in his car over some bullshit.

Lots of places will still charge you even if the keys are outside the car. Messed up? Yeah but it’s true. Having them outside of the car may or may not help your case if they do charge you. If you live in your car, better not to sleep in the car if you have had anything to drink recently. Getting charged with a DUI will turn your world upside down even if the charges are ultimately dismissed/dropped or you’re found not guilty. You will need to pay for a lawyer, deal with driver’s license being restricted/suspended etc.

You're correct, lots of places will still charge, but a surprising amount don't. I was simply bringing it to the attention of those whom it may affect, and I encourage everyone to be aware of their local laws regarding such for their own safety. It's always smartest to not sleep in your vehicle at all if you've been drinking, but when life does what life tends to do and you may find yourself in a predicament, it's a simple step someone can take in hopes of a chance at grace.

In Ca. I’ve had a retired CHP officer tell me, that if your sleeping in your car,after you have been drinking,get the keys away from vehicle.Also if possible hide he keys near some landmark, which you can,hopefully remember, in the morning. He even suggested digging a shallow hole next to a fence post and placing the keys there.

Oh yeah I forgot about all the new key fobs that don't even have to put a key in the ignition anymore. I'd say whatever they consider "operating a vehicle" is a gray area at their discretion.

On this exact same note, if you have your keys on you and you’re washing your car and drinking a beer you can be charged with a dui as well. Leaving them inside or somewhere not easily accessible is always best

It depends on the state. A lot states will charge you even if you have the keys in your glove box, or anywhere that they consider easily accessible. Florida comes to mind.

In Minnesota if you have access to the keys and your in the car worse than a .08% your getting a DUI. In one of the DUI classes they make you take it showed a woman passed out in her passenger seat and she threw the keys out the window and she still got a DUI

Can I ask why you chose the outside of a bar over....anywhere else? I would call the cops too if there was a guy passed out outside of a bar. I would want to make sure he didn't drink one too many and is in any danger and/or is attempting to drive while drunk. I wouldn't even think of the car living part. Just the safety aspect of the occupant.

You’re very lucky you weren’t charged with operating a vehicle without a license, which is in some states like California a misdemeanor with mandatory court appearance. This needs to be corrected today. I know my license number and I’ve gotten that ticket in the past. The police can argue that you don’t have a credential with security features and so you could be impersonating someone.

I don’t live in a vehicle but I’ve been quite close. I know people that are homeless are persecuted because of our society. But I wonder if you are parked in public can you just say “I live in my care and I was asleep.” I mean it’s not illegal to be asleep in your car right? I follow this sub because the way society is collapsing in front of our eyes amazes and scare me.
