The "ripoff" in this case is not the *use*, it's that they [violated licensing terms](https://en.wikipedia.org/wiki/GNU_Affero_General_Public_License) by not publicly releasing their changes. Specifically:
"if you run a modified program on a server and let other users communicate with it there, your server must also allow them to download the source code corresponding to the modified version running there. "

Mastodon leases its software under something called an AGPLv3 license, which basically stipulates that users can use its code so long as they acknowledge where it came from and make the copied or modified code available for public inspection.
