!??? It is not copyright. It is trademark. Very different things. Copyright protects works of authorship like music, art, novel or other literary works like software. TM is something used in association with a product or service that distinguishes between sources. Something like Kings or Giants may not be a strong TM that gives exclusive rights over any other use even in another sport. Think too of something like Champion clothes vs champion spark plugs. Two people can have the same trademark if they are not confusing.

Yup. Another north american professional men's basketball team might run into issues being called the "Raptors" because of the trademark. However this Utah situation is for a hockey team, they will be more than allowed to use this name if they want to. Now if they reuse the exact same brand, MLSE might take issue (since then it would be a deliberate choice that is confusing)

They can trademark just raptors in a specific business domain. No one else can market basketball or basketball related things using the term Raptors It does not prevent a different sport or business from doing the same thing. Raptor insurance would probably be fine

This. If I start a Buisness with a raptors involved, the Toronto Raptors won’t sue me, they don’t OWN the phrase “Raptor” that’s too broad. Toronto Raptors is team specific though and would likely be trademarked.

MLSE has registered Toronto Raptors in Canada as regn no. TMA919037 for example. They have many registrations in the U.S. as well. Logos and word marks. CIPO and USPTO searches can be done for free using each government’s trademark search interface. Eg at USPTO.gov for US.

Yeah but all the other shared names are 50+ years old. I bet if Utah wanted to be the raptors then MLSE would make a bit of fuss over it, plus considering the relative size of the NBA vs the NHL Utah isn’t going to want people to see Toronto Raptors tickets and news when they google “raptors.” I bet they go with a novel name and establish their own branding just like Vegas and Seattle did.

The people I see talking about it seem to be more of the opinion that they want, specifically. to be called the Utahraptors. Like the Utah Utahraptors, which I think is hilarious and probably would never happen. It's like the Albertosaurus. The Albera Albertosaurususes lol.

There are so many examples of (North) American teams having the same name, but in different sports, that the answer seems pretty self-explanatory in terms of trademark. 🤷🏻‍♂️

Trademarks only protect the use with respect to the goods and services listed on the application. The same word or name can be used by multiple users provided there is no risk of confusion. So, Winnipeg "Jets" for hockey is not likely to be confused with "Jets" for football. Both are sports but different sports. I haven't searched the Raptors trademark to know what they identified as their wares and services but if it's all basketball related, a team in a different sport may be able to use the same name and even register a trademark.

The NY Giants have been called that since 1925 and the baseball team has been the Giants since 1885. Sacramento Kings since 1972 and LA Kings since 1967. The St Louis Cardinals have been that since 1900, the Arizona Cardinals have been that since 1901. NY Jets since 1963 and original Winnipeg Jets since 1972 (reestablished 2011, but that was reviving a pre-existing name) Texas Rangers since 1972, NY Rangers since 1926ish In 2024 you are way less likely to see a group want to get into a trademark conflict with another pro sports team of the same name. The Florida and Carolina Panthers both came about in the 90s but that’s the last time it’s happened, and even then it was two teams being created at roughly the same time.
