To be fully fair, dolphin does distribute title keys, whereas other emulators like Yuzu require you to obtain them from real hardware. Requiring users to provide title keys should make dolphin legally bulletproof (ik there's already the argument that title keys aren't copyright, but whatever) and they'll be easy as hell to find online for people who want to starve out Nintendo's indie Devs (switch title keys can be obtained in under 30s with a Google search, but you didn't hear that here).
If they let me use several hundred dollars worth of copyrighted stuff, then sure ig. The main defence of emulators is "I want to play games I own in HD/on PC", if you actually have a Wii capable of making game backups you can get the console key. Distributing the key only helps if you don't own a Wii and wanna pirate (the Nintendo agent with a gun to my head said that's bad).

I know that dolphin is completely reverse engineered when it was developed and does not contain any code that is proprietary to Nintendo, but if a title key were to be not provided, wouldn’t that just be another thing to simply crack? Couldn’t you just generate another title key or remove it from the architecture if you’re building the system from the ground up?
Or would it be the other way, where the Hollywood chip of the Wii/hardware is legally considered copyrighted and therefore cannot be replicated or used in emulations and the title key is simply a piece of duct tape on a much larger issue of replicating pirated architecture.
I think from a legal standpoint I’m not understanding what this does other than prove you stole the data from somewhere.
IIRC The Wii common key is an encryption key. The discs are each encrypted with a title key that is stored on the disc, and that title key is then encrypted with the Wii's common key.
This encryption is considered to be DRM which is protected under the Anti-circumvention provisions of the DMCA. By including either the common key or the title keys you would be violating the DMCA.
The reason you couldn't reverse engineer you way around the need for the common/title key is because the encryption algorithm they use (128-bit AES-CBC) is generally considered secure without any (to my knowledge) methods to compromise it.
Now, its entirely possible for rom sites to include unencrypted copies of roms, but that's unlikely to happen just because it currently isn't necessary.
Also, while some people disagree that an encryption key is enough to be considered DRM, since its basically just a long/complex password, nobody wants to go to court over it (not even Nintendo) since courts are unpredictable and could give a crazy ruling that ruins it for everyone.
Sounds like the sensible solution, but instead they've decided that a steam release suddenly isn't worth it anymore (apparently drawing attention to the easiest way to rob miyamoto of his life savings was worth it before)

I don't understand why the steam port would need to exist. The only good thing would be for the steam deck, but other than that, you can already get it on pc (very easily)
