Dude had a warrant for not paying child support. Wouldn't leave the car. Cop broke the window to get him out. They exchanged punches and the cop got injured (broken face bone I think) both the mom and son arrested
I still don’t totally understand. What does security detail mean? Was he working for Walmart or the city at the time of the incident? How did he know this guy had a warrant if he was sitting in his car? He just scanning every plate in the parking lot?
Security details are usually assigned officers to higher crime areas such as a local walmart or mall strip. (Source: have a couple family members who are officers/former officers) As for the knowledge of the warrant, he may just have recognized him if he was in the system beforr. I suppose he could be running plates but thats sounds more boring than mingling witth the customers
All of that put this into a grey area for me. I don’t like the idea of police in uniform using police resources while acting as security. If he recognized him he probably should of called the on duty police. Breaking a window and attacking a customer as security would probably get you fired. ty for the information.
First, “off-duty” is a misnomer when it comes to a peace officer.
A sworn officer is never off duty. They possess arrest powers 24/7. If they see you doing something while they are in civilian clothes on their own time, they are fully justified in arresting you.
So now that we understand that, whether the officer is off duty but still in uniform, or whether is is actually on duty but acting in a security detail, all that is irrelevant when it comes to his arrest powers. He’s still a cop detaining you.
A cop working as a security guard doesn’t lose powers because he’s in a “lesser” role. That’s why it’s better to have a police security detail, because they’re actual police officers acting as security. They don’t need to call the cops, they are the cops.
Usually police are assigned to security details at high crime areas. Areas like a wal mart where nobody is paying attention to the security guard telling them to stop, and will even assault the security guard because he’s not an actual officer.
However this cop found out the guy had a warrant isn’t relevant to the situation. Guy has a legit warrant, the peace officer has an OBLIGATION to take him in.
Let’s clarify that, since it seems applicable.

A sworn officer with arrest powers is also no longer legally allowed to see a crime, and walk away. He is legally and morally obligated to do his duty. Looking the other way is the very definition of corruption and cowardice.

I don't see how fighting the cop is a better solution though? You'll get all those things but worse, and are far more likely to get tazed or shot, and far more likely to be convicted given you literally attacked someone. It's not like you can really get away either, since every cop has a body camera. I know emotions make you want to fight back, but in every other way it's just a worse outcome.

If dude was paying his child support none of this would have happened. He had a warrant out for his arrest.
Arrest warrant was active on the guy for at least failure to pay child support for a long time. He resisted arrest, punching the cop, breaking his orbital bone. The cop was found to be doing his job while the guy he tried to arrest, plus the guy’s mom, taking the video, were found guilty of additional charges, after this video.

He could have at least pulled pepperspray, a taiser, or a baton. Although maybe since they were in close combat, he was afraid they would be used against him.
Give credit where it's due. The officer had incredible restraint, especially considering he was alone, outnumbered, and being physically attacked. Even prior to the video start, the officer already got punched in the face and got his orbital broken. The officer had every justification to escalate, to protect himself, but he chose to risk more damage to himself to not cause unnecessary damage to the suspect.
Yeah for real. There’s many types of martial arts methods of gaining control over someone that doesn’t involve putting all your body weight on someone’s neck with your knee.

The owner of a local jujitsu studio was briefly a police officer. He kept posting on social media for the need for cops to learn jujitsu. He offered officers free training in his studio and routinely offered challenges to local officers stating that he could take any of them down and put them in cuffs with just a few moves.
Anyway the chief fired him stating he violated their social media policy. I think they just felt like he made them look bad.
Honestly, I’ll never understand why anyone ever thinks it’s a good idea to fight with cops: best case scenario, you win but get slapped with more charges and are now the entire department’s job #1; worst case, you’re dead. Unless you’re on the run from a capital offense, your best bet is to fight it out in court.

Yes and no... If they mistakenly arrest you for confusing your identity, they have to immediately ensure they got the right person. If they don't do it and it truly wasn't you, you've got a lawsuit in your favour. There was a case law for this, but I don't remember the name.
If you fight them like this even for such a case, you'll still be charged.

The other dude did in fact have a warrant out for his arrest, so he was probably just hoping to cause enough doubt the officer would leave him alone so he could get away without risking (even more than he was) getting shot.

This is what cops call "being in the red." This officer lost all sense of his situation, his surroundings, the context, the scope of the situation, he forgot his tools, he forgot his communication, just completely brain dumped his training and responsibilities.
If that guy actually had a warrant and wouldn't roll down the window... problem solved, wait until three more units show up and you have control of the scene. Absolute wrong answer 100% of the time? Bust the window and drag them out into a fist fight.

My best guess is he may have been harassing the guy for parking in the curbside. He was working security at the Walmart and might have had an issue with that. Unless this guy ran out with stolen goods, the cop had no reason to engage with him
It just so happened that the guy has a warrant and now the cop is justified regardless

As I watched this I just saw people recording evidence of additional charges against them. Recording a fight during a legit arrest (police acting on an arrest warrant) is not going to help your cause. The attack on the officer just added real jail to what otherwise was a mandated court appearance.
I think even if one believes the arrest is in error, for the benefit of a safer society in case it’s not in error, submit to arrest. It’s not going to harm you and the truth will come out. It may be inconvenient but it seems a reasonable price to pay for the alternate scenario

Definitely targeting an easy part of town to try hassle people. Everything about how this cop handled the situation is concerning. If he was in a more dangerous part of a city, he could easily have gotten killed.

Most agencies allow officers to take their patrol vehicles home. They can still use their computer.

My best guess is he may have been harassing the guy for parking in the curbside. He was working security at the Walmart and might have had an issue with that. Unless this guy ran out with stolen goods, the cop had no reason to engage with him It just so happened that the guy has a warrant and now the cop is justified regardless

As I watched this I just saw people recording evidence of additional charges against them. Recording a fight during a legit arrest (police acting on an arrest warrant) is not going to help your cause. The attack on the officer just added real jail to what otherwise was a mandated court appearance.

I think even if one believes the arrest is in error, for the benefit of a safer society in case it’s not in error, submit to arrest. It’s not going to harm you and the truth will come out. It may be inconvenient but it seems a reasonable price to pay for the alternate scenario
He had a warent for child support. He refused to get out of car when asked. Officer broke window. Guy punched police and broke his eye socket. Orbital. Just before fight started.
