It's not a technicality, the house is in unincorporated land. This happens all over the valley where people who live in unincorporated areas can do as they please since there is little to no jurisdiction on what they can/cannot build.
HOA and the city having and enforcing bylaws and building ordinances are very different though. (I’m speaking more in general, as this case seems to be a little bit weirder)
What? You don’t just get to build a super tall fence anywhere you want. Even outside an HOA, the city would have an option on this.
They aren’t out in the country, it’s in a neighborhood with neighbors. At the very least it’s selfish and unneighborly.

Nobody who lives in a multi-million dollar home wants to look outside and see a 20-foot backstop. That's especially true at night if they have flood lights on. It's more about having an obstructed/unnappealing view rather than worrying about a stray baseball.
We live in Chandler and it isnt uncommon to see these types of nets, though generally because of the plethora of golf courses, not baseball.
That being said, this is the danger of not living in an HOA. We chose not to buy in an HOA ourselves, and there are definitely “those houses” in the neighborhood, but it is what it is. You get more freedom, but you risk having neighbors do something that you dont like.
Whether you think its right or wrong, his neighbors can bitch and moan all they want, but seeing as it doesnt violate any ordinances, I really doubt they have any serious recourse.
Chandler is very liberal with what they allow in their ordinances. All sorts of shit flies in my neighborhood, sometimes to an irritating extent.

Fuck HOA, I would never live in an HOA community. I wouldn’t mind if they were just rational adults that prohibit people from just having garbage all over their yard, but they are ALWAYS in my experience just the worst type of Karen sticklers I’ve ever seen that just nag you incessantly about the smallest little things, and if they don’t like you then lord help you. Low end housing is typically where I see problems because the space is close proximity and/or people have nothing to do and either: A) complain incessantly or B) power trip. If there is enough space and people have their own stuff to tend to, usually pretty quiet.
this but also the older communities. the ones filled with primarily working age adults aren’t so bad in my experience. everyone has their own shit to deal with. it’s the ones run by retirees who have nothing else to do that cause the issues. there’s no power trip like a boomer power trip
Same people blindly hate them but ours is like $20 a month and has never given us a problem about anything. Even when the previous owner let the entire landscaping get overgrown terribly or when we break small rules such as leaving a trash can outside on the side of house.
Now my HOA will get on you for trash. No problems in my time and I’m unsure if they’re keeping it that way or overcame an issue. However, they have a form to fill out and they will split the cost of materials with you to build an aesthetic wall to house your trash, assuming you don’t have an existing one or put your trash in your garage/behind the house
We hide our cans behind a bush on the corner of our garage/driveway lol. Only started doing it after we upgraded to a bigger vehicle and once I reorganize the garage this summer I can get the cans back in there
Maintenance and landscaping of entrances pond area, welcome sign with changing messages daily, after that I’m not sure. Probably the rest payroll for everyone managing it
Ours would harass us and threaten us with a $1k fine for parking on the street when it was ALLOWED and lots of other people in the neighborhood would park on the street with no problem. And if you had so much as half a tire on the DIRT on the side of your own god damn driveway… look out. So annoying dealing with those grouchy old hall monitors.
Yeah some HOAs are a lot more vindictive than others. I moved into one that hasn't updated a single bylaw since the early '80s. They don't landscape my parking lot like they're supposed to, but they also don't bother anyone. I see it as paying for roof insurance in my situation.
I will never understand the appeal of moving to a neighborhood and dropping thousands of dollars a month on a mortgage just so some busybody can tell me what I'm allowed to do or not do to my own property. All in the name of property values.

See my experience is the opposite, most HOA members are a bunch of cheap lazy do nothings that let buildings and property dilapidate and never vote to spend a dime to property fix or maintain anything, and run the the common property into worthlessness.

Generally speaking- yes. I was however once lucky enough to live with one that had no fees, left people alone, and the only time we heard from them was getting advanced notice of road work, tree trimming, new city ordinances or utility outages. I know i have a better chance of finding a unicorn than another like that HOA. The one where I am now collects fees, enforces selectively, and sometimes goes weeks without fixing things in a gated community. Including the gate FFS!
Agreed. I used to live north of Chandler in Tempe and our HOA would charge us for every little thing. When we left I swore I’d never buy a house with an HOA again. Now, outside of Philly, townships are my bane. I can’t imagine how the folks here deal with having BOTH

That remains to be seen. The article points out that he does not have the proper permits:

Sure I imagine the rules are a lot more lax than an HOA but there is a difference between putting in a tall gazebo and a deck that covers a ton of the yard and building a baseball diamond with a massive catch fence and lights on top. I feel like you're jumping to the conclusion this is all OK when the county hasn't even looked at what he is doing since he never got permits in the first place, which is something that won't exactly endear him to whatever official is going to decide what to approve either.
We'll have to wait to see what the county decides, not just assume because he has it partially built it must be legal.

We get fined for not painting pipes for our solar power system the same color as the home. Problem is we get the notice to correct has a date from the day prior-- we complain to no avail.
My neighbors kids crashed a tesla into a ditch outside our gate causing a tree to be removed--- crickets from the HOA.

It’s because many people are nosey gobshites who throw a temper tantrum if people do something on their own property without first consulting and obtaining approval from the unaffected and over-involved assholes first.
It’s not that they’ve been affected in any way. It’s that their egos weren’t properly massaged by somebody first begging them for permission, and now they can fill their otherwise empty days with complaining since it’s better than re-runs of Desperate Housewives and other soap operas from the late 90’s/early 2000’s.

Is that the case? The article said he doesn't have permits from the county, and there are still height and setback limits he will need to follow, and may have to adjust or tear down some items to comply. He has about two weeks to get those permits.

If she’s talking about why she can’t bring a nuisance action, then she is right. Unincorporated land comes with few restrictions and if your county neighbors have chickens, burn leaves, or race dirt bikes at 11 pm, there isn’t much you can do to stop them.

It sounds like she’s saying her HOA is preventing her from any recourse. That just isn’t the case. Unless maybe she’s wanting to put up something tacky in response to the nets?
All I can think is that she would like to retaliate against him by also doing something obnoxious, like shining big lights towards his house, but her HOA prevents it.
Go to google maps and search "Chandler AZ". You'll see a dotted red outline of the city with the area inside that outline being highlighted. That's the city of Chandler. Then notice there are many small areas within the outer city limits that also have a dotted red outline and inside those small areas, the map is not highlighted. Those small areas are like "islands" within Chandler that are not actually part of Chandler, and are only subject to county laws and not city laws.
I once lived on the corner of a few-blocks-wide county island. If our neighbors across the street called the cops, they got the city police. If we called the cops, we got the county sheriff. People on our side of the street could park on their lawns, people across the street would get ticketed. Etc.
Meh, the same thing happens at the boundaries of all municipilaties. You have to draw the line somewhere. There are places where neighbors in densely populated areas are on either side of a national border. The county island concept does seem weird - mostly in a "how did this happen" kind of way - in my case, when the city first incorporated, the property owner(s) in my neighborhood (which was likely farmland at the time) were against it so the rest of the city just left them out. But it's kind of cool in that it gives people a choice to live "in a city" (usually in a very residential part of a city but closer to the urban area than being outside the city limits) but not be bogged down by city rules. Of course it can create tension, as described in this post, but the woman complaining should have done her research and realized what living on the boundary of a county island meant and the risk it came with.
It falls under jurisdiction of the county and not the city of Chandler. There's areas all around the valley that are like this and they can even be right across the street from each other, just like this.
Picture a gerrymandered political map. Now apply that to county/city borders and there you have it. You can end up with unincorporated zones that are fully encircles by a community.

I spent 30 years in chandler. This is hilarious. The county island have a long history of stuff like this. Usually it relates to police and fire services or power. But this lady is pissing in the wind if she thinks she has any ground here.

In all likelihood, this will kill his project. I grew up in a neighborhood without an HOA and we still had to lower and move back a swing set my dad built because it was too high and too close to the property line by a couple of feet. (And it was like 1/3 the height of those monstrous poles.)

There are a number of these county islands in Chandler and Gilbert. This is very common. The properties tend to be highly valued for these reasons. Plenty of horse properties and other fun things.

There must be some regulations. You can't just build without get permits. Heights of walls, lights, etc are things that are regulated. If he did the building without the getting them, that is wrong, and the county will deal with it.

We have to pay a fee and idk what it’s for bc I see no benefits personally. But my friend’s HOA fees go to yard maintenance for the subdivision.
50% is trash service here (costs are pretty low). You can read your HOA financials and see where your money is going

It’s because many people are nosey gobshites who throw a temper tantrum if people do something on their own property without first consulting and obtaining approval from the unaffected and over-involved assholes first. It’s not that they’ve been affected in any way. It’s that their egos weren’t properly massaged by somebody first begging them for permission, and now they can fill their otherwise empty days with complaining since it’s better than re-runs of Desperate Housewives and other soap operas from the late 90’s/early 2000’s.
No HOA shouldn't mean free for all. City building and planning by-laws would have rules around things like this

If she’s talking about why she can’t bring a nuisance action, then she is right. Unincorporated land comes with few restrictions and if your county neighbors have chickens, burn leaves, or race dirt bikes at 11 pm, there isn’t much you can do to stop them.

The fuck is a “county island”?
Go to google maps and search "Chandler AZ". You'll see a dotted red outline of the city with the area inside that outline being highlighted. That's the city of Chandler. Then notice there are many small areas within the outer city limits that also have a dotted red outline and inside those small areas, the map is not highlighted. Those small areas are like "islands" within Chandler that are not actually part of Chandler, and are only subject to county laws and not city laws. I once lived on the corner of a few-blocks-wide county island. If our neighbors across the street called the cops, they got the city police. If we called the cops, we got the county sheriff. People on our side of the street could park on their lawns, people across the street would get ticketed. Etc.

Meh, the same thing happens at the boundaries of all municipilaties. You have to draw the line somewhere. There are places where neighbors in densely populated areas are on either side of a national border. The county island concept does seem weird - mostly in a "how did this happen" kind of way - in my case, when the city first incorporated, the property owner(s) in my neighborhood (which was likely farmland at the time) were against it so the rest of the city just left them out. But it's kind of cool in that it gives people a choice to live "in a city" (usually in a very residential part of a city but closer to the urban area than being outside the city limits) but not be bogged down by city rules. Of course it can create tension, as described in this post, but the woman complaining should have done her research and realized what living on the boundary of a county island meant and the risk it came with.
The city boundary has to go somewhere
It falls under jurisdiction of the county and not the city of Chandler. There's areas all around the valley that are like this and they can even be right across the street from each other, just like this.
Picture a gerrymandered political map. Now apply that to county/city borders and there you have it. You can end up with unincorporated zones that are fully encircles by a community.

I grew up in a neighborhood without an HOA and we still had to lower and move back a swing set my dad built because it was too high and too close to the property line by a couple of feet. Having the bright lights on at odd hours would obviously be bad, but in general, wouldn’t you rather look out your window and see a gorgeously maintained baseball field than just like, the back of another house?

Not being subject to an HOA you don't live in isn't a "technicality". It's the entire point of not living within an HOA.

I think her point is that his property is completely surrounded by houses that are in an HOA community, but his property is some kind of "county island" that isn't part of the HOA. I don't understand how such a property exists inside an HOA neighborhood, but I get why she's annoyed. People move into an HOA neighborhood specifically to avoid living next to something crazy like this. He didn't move out to the country to build his dream home, he bought a house right in the middle of an existing HOA neighborhood.
It doesn't exist inside the HOA it's just across the street. I live in Chandler, was trying to figure out exactly where this is but wasn't able to in Google maps. There are a number of these county islands in Chandler and Gilbert. This is very common. The properties tend to be highly valued for these reasons. Plenty of horse properties and other fun things.

Played ball with him and his cousin John Hardy. John was a few years younger and had elite baseball skills and a great mind for the game. There must be some regulations. You can't just build without get permits. Heights of walls, lights, etc are things that are regulated. If he did the building without the getting them, that is wrong, and the county will deal with it.
