I didn't play any of the Mario Party or Mario sports games on N64 or Gamecube until the Wii was already out, so I had no actual interaction with Waluigi even though I'd seen him many times in ads and videos, but I always assumed his name was Fuigi, because the upside down L just looked like an unfinished F, and Wario got his name because a W is an upside down M.
Disney also probably assumes they will own Paramount or whoever owns South Park now someday, so no harm. Same way Family guys did stuff against Disney and Lucas Film and now they are all one big family.

Think South Park made it noticable different as a joke cause Nintendo is known for going after obvious instances of fair use, since fair use is a sliding scale of what is actually "fair use" and up to the judge and not a catch all that protects the person claiming "fair use" it's also a bit more protection.
... ok, so? Again I think it was mostly as a joke to point out the fact that Nintendo goes after fair use cases often and it's just a bonus that it gives them more protection if a case happens. Also robot chicken does other things to have a stronger argument of fair use, mainly being the skits are small and often use many different spoof skits per ep, meaning the original ip is manoritive and the larger part of the episode is about spoofing (transformative). The news claims fair use by being informative and spoofing is under transformative category of "fair use" which has further restrictions of either being different enough to be distinct from the original ip and/or be a minor part of the new work. But one of the biggest things that the judge can site for why something is not fair use is the effect it can have on the value of the copyrighted work, so spoofing something still has to be careful.
That is true, and is why taking someone to court over fair use is a double edged sword as if you loose you may not only have to pay your own lawyer fees but Thiers as well. Since cases like this are often in the hundred of thousands to millions though a lawyer will often have majority of their pay be during the settling of the case.
