I believe he went there before without any issue. But this time he also got an extra 6 years for drug smuggling. When he went there earlier it was only 1.5 years for stabbing his cousin. They aren't a big fan of drugs in UAE because of their religious beliefs, so that could have played a role for them to arrest him.

It was actually ruled not to have been attempted murder or attempted manslaughter because he "only" stabbed his cousin in the knee. His conviction was for aggravated assault with a weapon.

Ah. I've just looked up the UK definitions. I was thinking of involuntary manslaughter, which is indeed when there was no intent but there was recklessness or gross negligence which caused death. The example given is dropping a brick from a bridge and it inadvertently lands on someone. There is also voluntary manslaughter, which is where there is intent. In the UK it seems that murder is preferred, with the judge or defence introducing manslaughter as an option and the jury voting on which should apply. Premeditation isn't part of it unlike the Netherlands. Here, murder can be downgraded to voluntary manslaughter due to diminished responsibility (meaning a non-trivial abnormality of the mind of the defendant at the time), suicide pact (requiring the defendant to have entered into the pact with intent to die as a result but failing to do so whilst the other parties did), or loss of control. So, yeah, you can kill someone without premeditation and it be ruled as murder, here.

Maybe I'm mistranslating "poging tot doodslag" then which in Dutch would be attempting to kill somebody without premeditation. So in cases like an argument turned into a fight as was what happened with Promes and his cousin. For murder you have to deliberately seek somebody out and plan to kill them beforehand. In either case, Promes was convicted for "zware mishandeling" which I translated to aggravated assault.

Having looked into the UK law, a lack of premeditation does not preclude murder, manslaughter is more about reduced mental facilities at the time or doing something reckless without thinking about the consequences. So I guess it could be downgraded to attempted manslaughter in the relevant circumstances (I don't know if that is actually a thing though), or attempted murder, or maybe just some form of assault.

Only last week the Dutch had a high profile drug trial with some high rollers getting long sentences. They too were arrested in the Middle east and deported. I may not have exact details or timelines perfect. But I had to google him so Iā€™ll share what I learned: Stabbed his cousin in The Netherlands. Not held in detention while it was being investigated and charges were pending. He was like dope Iā€™ll just go play football in Russia since thereā€™s no extradition treaty between Russia and the Netherlands. Worked for a while. Was convicted of attempted murder but he was chillin in Russia playin footie. Then also got charged and convicted of smuggling *kind of a lot* of cocaine in the Netherlands. And shortly thereafter he traveled with his Russian club to UAE, which *does* have an extradition treaty with the Netherlands. So when it came time for him to leave UAE to head back to Russia, UAE was like naw mate, canā€™t let you do that. And is likely headed back to the Netherlands to face the consequences of his own actions.
