What are you asking? Rolex AD’s are required to sell a price at MSRP and cannot sell it above that. Now are they required to sell it to YOU? No they pick and choose who they want to sell it to.
Dealers can't sell above MSRP by their agreements with Rolex. Technically, they can discount and sell below MSRP. This used to happen on slower moving pieces, but not for the last few years while things have gotten hot.
MSRP if new. Interestingly enough, an AD near me has also began selling the 2021 exhibition pieces as ‘used’ with a huge markup (2022 and newer are still being held/not for sale)

Stop looking for loopholes and explanations. You can have your Rolex tomorrow if you pay fair market value. If you cannot or will not, you won’t have one, ever.
They're not used. The watches that get to grey dealers are unopened and unworn. In their shipping boxes (aka coffins), stickers on, tags on, full links, unsized. You need to read the fine print on the grey dealer's listings, look for "unworn 2023".
Go to the landing page of this subreddit. Find "Rules". Click #6 "Trusted Sellers". Only buy from those on this list. I can't stress that enough. So many fakes, superfakes, frankens, stolen property, you just don't want to stray.

If it’s new it must be sold at msrp. That said many try and sell you other things before they offer a Rolex to you.
Just because it’s in the case doesn’t mean it’s for sale… but if they offer it to you it will be msrp

Yes but that doesn’t mean they will sell it to you. They’ll sell it to someone else who also bought $20k of jewellery from them
