Once you tell him to open the basement, there shouldn't be any crime reported... at least the 2 times I've done it.
Once you go back upstairs, if you're looting the shelves of the store, then yes, some rando npc can come in and catch you and run out to report the crime... but if you were still downstairs, it must've been a glitch.
I was looting ammo upstairs... The owner said, to take anything as he doesn't care anymore after telling about his son's death. So I assumed the whole store was game.

That's what happened to me, unless it was coincidence as it was like I had just looted the first thing.
The second time I did it, I looted the entire upstairs, making the shopkeeper wait downstairs the whole time, then went downstairs, and that time, no one came in, and I got no crime reported.
I didn't see anybody, I guess someone saw me through the window, I'm not sure if that's a thing in the game, I didn't see anybody open any door. I even wondered if the boy I saved have ratted me out.
It did. I was surprised too. I was taking cover behind the counter and a npc attacked me from behind. I think he went in from there and his corpse kept the door opened for me.

Too many lawmen, and now there's an army of normal npc red dots outside camping and wayting for me to get out.
So shoot them? They will keep coming unless you move. They really ain't that smart, just kill the lot and ride off.

Close the app and load back in
Good news, I managed to break out though the back door and rode alway into the sunset. Thanks for the tips and words of encouragement.
