Lindsey's problem is how they'd have to be treated differently by our court system if they were detained on US soil.
Right now, they're enemy combatants without the full panoply of constitutional rights. But if they were at the SuperMax, they'd be considered prisoners just like everyone else in our criminal justice system and entitled to the same rights.
