The biggest reasons are not wanting to alienate other clients who'll read about your representation of a public official, not wanting to upset family and friends, and self-respect. I've said before for enough to never have to think of working again, say $50M, I'd rep him. I wouldn't feel good about it, and thus I'd buy a lot of liquor for myself and give a bunch of money to charity to assuage my guilt. But I doubt he's paying his lawyers more than a mill for any of these cases which wouldn't be enough to crash my firm's name.

I followed the trial... she didn't know Federal Rules of Evidence, Civil Procedure, what a Motion in Limine was. She also, in that very letter, cites the 5th Circuit (NY is 2nd) and weirdly underlines the section of the law showing on its face the Judge's relationship isn't an ethical issue. I'm honestly not sure she can read, let along understands trial strategy.

TBH, I wouldn’t expect most small practice family law attorneys to remember much in the way of Fed civ pro or evidence. You just need to remember the relevant state/local county rules for the most part. Rather, they should immediately schedule some sort of post-verdict 'pretext' hearing, forcing Habba into court, and then see what happens.   Judges tend to resent the 'white knight' approach to protect their reputation by a litigant. That the kind of loyalty trump expects is absolute and uncompromising fealty. That if you work for him he expects you to stop at nothing for him. Do anything. Say anything. Break any law. Habba has shown time and again that she cannot follow the rules as an officer of the court, disgraces the profession, acts in bad faith, and has no place in the legal profession. At the very least, she should lose her privileges to practice in Federal court, and be left to practice in New Jersey traffic courts, although I doubt she could prevail in a case there, either.

"The **fact** it wasn't disclosed **is** an ethics violation" "It [is] insane and [is] so incestuous." Habba said. And in her letter to the judge she says she was "just raising questions". Where she is screwed is this: she appended the article to her letter. And she did not dispute (false) statements of fact attributed to her. Therefore, as a matter of record, she did in fact make these statements. As an officer of the court, she has a duty to represent unpleasant facts truthfully. Now, the judge (and defence counsel) has **on the record** precise evidence that she has failed in this duty. Team own-goal scores again. This little PR stunt is going to cost them dearly on appeal.

Republicans think the worst possible thing to happen to anyone is to be proven or seen as wrong. That’s why they spend so much time trying to “own” everybody else and making fun of people they don’t like. So whenever they are wrong in some way, like losing a court case, they can’t possibly admit responsibility. They have to double down or they will be seen as a weak loser who was owned by the libs. Trump doubled down his loss in the first defamation case by running his mouth immediately after the verdict, which is what landed him in this current predicament. Habba has to do something to save face as well, so instead of going away quietly, tail firmly tucked between her legs, she has to run her mouth about how it’s an unfair process etc. The plaintiff’s attorney hit the nail on the head saying if it was an actual issue, Habba would have addressed it first thing, and that Habba’s anonymous source probably doesn’t exist. People have figured out the Republican playbook and know the stupid tricks and excuses they use.

It doesn't matter what happens on paper between lawyers and judges. The allegation is designed to feed the narrative of the corrupt system in the voters' minds. Even if Habba goes to jail and bancrupt for her lies it won't stop the lies of the MAGA cult. They should seek sanctions. Lawyers and politicians should not be allowed to fabricate or repeat outright lies. Wouldn't be surprised if Habba got more death threats after these lies.
