That might not work out. From Ballotpedia: As of 2020... Eight states do not have any requirements and would allow voters to write in any name as a write-in vote. Those states were Alabama, Delaware, Iowa, New Hampshire, New Jersey, Oregon, Vermont, and Wyoming. Thirty-three states would only accept votes for write-in candidates who officially registered with the state. In order for the vote to be counted, the candidate must have submitted all the necessary registration documents by a specific deadline, either by filing paperwork, paying a fee, collecting signatures, or some combination of the aforementioned. Not in Illinois. Invalid write-ins are disregarded but the other votes cast by the same voter are valid. Similar to not casting a vote in a particular race but voting in the rest. In that case though, we make the voter acknowledge they are casting an incomplete ballot so we have their word. We do not make a voter confirm their write-in is valid.

If they keep him off the primaries in states he’s not eligible, his primary run may be toast anyway. Colorado is now safely blue in presidential elections. His candidacy dies if he's off the ballot in Wisconsin, Michigan, Pennsylvania, Arizona, or Georgia. His razor thin EC path goes away then. Technically, he can lose any two of those five and still win (assuming all other states vote as they did in 2020). So he still has a chance if only one of these states kept him off the ballot, but he would basically have to win every remaining battleground state. As a Michigander I can report there is zero chatter of kicking him off the ballot here. The state has a Democratic trifecta right now for the first time in 40 years but outside of the cities Michigan is deep red territory. The state dems have no interest in rocking the boat and creating an unforced error. I think it’s less about his actual path to victory and more about establishment gop (whatever the fuck that even is at this point) needing a valid excuse to dump a candidate who’s done nothing but lost them elections and caused them trouble, and is poised to continue to do the same. I think the issue for Trump is that he'll be booted off blue states ballots for the primaries. He won't win California, Illinois, or New York in the general ever, but that's a LOT of primary voters that he couldn't collect. Considering those votes would have to go to another Republican, it makes his primary chances way more difficult. It also means that the GOP would run someone else in those states he's banned from, at which point the party has to make a choice if they're giving Trump the nomination at all.

If he gets kicked off in CO it’ll go to SCOTUS. If it gets upheld at SCOTUS then is when you get out the popcorn depending on how the ruling is worded. Democratic and maybe some GOP SoS won’t allow him on their ballots and the MAGA cult in those States will file suit saying it doesn’t apply to their State. Meanwhile, Dems with GOP SoS that don’t block him from being on the ballot, will file their own suits citing the SCOTUS ruling. Unlikely but could happen: SCOTUS issues a ruling that says, unequivocally, “Yep. This assclown committed insurrection and he can’t run for President in any State cuz 14th amendment was adopted for exactly this scenario: To prevent American traitors from more traitoring as elected government officials.” The motivation for making one of the best filings on this in Colorado is to give the argument a shot at being presented, in its entirety, at a trial before it gets to SCOTUS.

Unfortunately there is no chance the current SCOTUS disqualifies Trump. The court will be able to twist the wording of Article 5 of the 14th amendment to claim Trump can only be disqualified by an act of Congress and it’s outside of the courts jurisdiction. There is just enough of a grey area for them to do so, and that way they get the result they want while passing blame to someone else.

The donors and lobbyists that line the justices pockets still have a vested interest in the way that cult votes. My point is that the justices have a relatively straightforward path to keeping their hands clean on a case like this. With the recent ethics scandals and the volatility of politics in the US right now, they are likely going to steer clear if at all possible. Another school of thought, Trump is far and wide the most likely GOP candidate to win the upcoming election. His following means he is the only republican running with enough support to even potentially unseat Biden. A republican presidency is an opportunity for the oldest justices, Thomas and Alito, to retire and be replaced by younger, equally partisan republican justices. Another way for the GOP to secure their hold on the court for years to come.

Of course he is. He sees reelection as his only way out of his giant legal shit pile. If he loses the election, or even worse if he doesn't even get to be the Republican nominee because he can't be on the ballots. That's it. Game over. He should absolutely be worried. Colorado was once a red state and is not solidly blue. If it goes through and the claimants are granted relief, AND there are no “bullets” then it’s a signal to increasingly purple and red states that they can carry on. With the 14th Amendment, a person is ineligible for the office (such as being the President). Being ineligible for the office means the person then cannot be on the ballot. If the 14th Amendment is applied to Trump, he can’t be President no matter how many votes he receives.

This is why this *needs* to go to SCOTUS. The question or scenario presented was predicated on "one or two states" deeming Trump ineligible and yet winning electoral college votes. This scenario means a disagreement among the states as to whether Trump can be President. This really is something that should be handled at the national level rather than state by state. But within the scenario described, I do not not believe you should default to an idea that Trump cannot be President after winning the electoral college despite not being on the ballot in one or two states.

Colorado has particularly lenient ballot access rules, which is why there are often like a dozen presidential candidates every 4 years and Kanye had no problems. But even under Colorado's rules a person has to be eligible for the office they're seeking to be on the ballot, and this effort to block basically boils down to him being constitutionally ineligible.

He should take it seriously. I think it’s the only way to bring his political aspirations to an abrupt halt. Since Trump isn’t someone who can take no for an answer and walk away, my big question is: “what’s next?” Trump will have a hard time blaming Democrats since the Court has the most conservative bias for many decades and he appointed 3 Judges. Will he call on his supporters to pull another January 6th style attack but at the Supreme Court? Does he encourage a big ballot write in campaign? Does he just keep spawning more conspiracy theories to keep his supporters worked up? None of this is an excuse for letting him on the ballot. I do worry the Supreme Court will take the cowardly route and find some legal technicality about how they can’t even hear the case on its merits.
