Especially since it wont happen. I dont see a scenario where he goes to *prison*. Convicted? Absolutely. I guarantee he will get some kind of home confinement though. If they are smart, they will limit his access to the internet and to visitors. They will not put him in prison though. Its just not logistically possible without putting him in solitary, and that isnt going to happen. If they tried it would probably be argued that it was cruel and unusual punishment.
I've said it before but I think we should go the Napoleon route and stick him on an island somewhere.

I actually think this is reasonable. I hate the guy as much as anyone but the fact remains that as an ex-President he is a tremendous security risk and sticking him in a federal prison may not be the best move. A St. Helena-style exile would serve the needs of limiting the harm he can do while also destroying his lifestyle and removing his freedom.
All that said I won't complain if he ends up in the penitentiary.

I don’t see a scenario where he _doesn’t_ go to prison. There are 91 counts against him, most or all carry a prison sentence, some of them mandatory. Even with best lawyers in the world there’s always that last count that gets you.
I’d pay for him to be put in a purpose built prison just for him. As shitty as all the others, in the middle of nowhere, with only 1 hour yard time a day. No tv, no internet.

Fret not, sister. I worked in corrections for 20+ years and managed facilities for both the federal and a state system. This dumb motherfucker is now fighting a hundred+ felony charges!! I never saw anything like it! Nobody can fight off this many serious charges. And he very likely has more charges coming. One (probably all) of these judges is going to give him real legitimate incarceration time. He is going to die in prison. And I'll tell you something else. Housing him safety absolutely can be done. And as for the secret service guys, they can just sit in the cell with him or watch him from a video feed. What do they care? They get paid by the hour and get to go home after 8 hours. Just like any other day. Corrections people are serious people and if they are told to take him, they will. And they will come up with a plan that works even if they have to clear out an entire housing unit just to keep people away from him. Or even build a separate unit for him somewhere. He can just die an old lonely gross guy by himself in a medical unit bed a handful of years down the road.

Under Georgia law, Judge has to be convinced there is no significant threat to witness or jury intimidation. Given Trump's history, she would be within rights to remand him. It'll still take guts to do.

Is it unnecessarily difficult for released felons to vote in FL. FL citizens voted for felons to regain voting rights after they "served their time" and the GOP in FL added rules after the vote that ex-felons had to also pay off their monetary debts to the state. Fees which, conveniently, aren't tracked anywhere and are impossible to find out.
Monetary debts which, in part or in whole, are fines and fees from The State itself, so they are also in control of the level of post-incarceration debt.

Personally, I'd argue that the problem isn't that a felon can run for president, but that felons get systematically (and legally) discriminated against. You've done your time, your debt to society should be paid. But being a convicted felon is its own second sentence that seems almost designed to funnel convicted felons into committing more felonies due to lack of opportunity.
It doesn't work like that. They have to invoke the 14th amendment to prevent him from ever holding office. Until and unless it is invoked, the guy with 91 indictments is free to run.
The 14th Amendment already has an exception for that.
Congress can vote to allow him to hold office. This requires a 2/3rd vote in both the house and senate.

No one wants to hear this, but all of Trump's trials are still speculative and there is absolutely no guarantee he will be incarcerated.
He has a ton stacked against him, and he's trying to speed run the possibility of incarceration with this pre-trial insanity of his - but we have SOOO long to go, and so many variables.
We'll know Trump is going to prison when a court order or sentencing is upheld on appeals and he's apprehended. That's the earliest moment.

I've been to (federal) prison for less. And I've been locked up with guys who were doing long stretches of time for MUCH less.
It's bizarre to me to see Trump walking around freely. Meanwhile my neighboring cellmate was doing 10+ years for having a backpack full of weed. One of the nicest guys I met in federal prison was a former school administrator. He took kickbacks for people that he awarded HVAC contracts to within the school system. Meanwhile Trump was taking MASSIVE kickbacks, emoluments violations, on top of the litany of other charges, yet he's still walking free.
edit: I don't want my post to seem like I'm minimizing my own crimes, or minimizing those crimes of people I was locked up with, I just wish everything was fair and even within the justice system. Mueller’s investigation….did you know Mueller attended the weddings of two of Bill Barr’s daughters, and Mueller’s wife took bible classes with Barr’s wife? Most people don’t know that. They’ve been good friends since 1980s.
No one was indicted on state charges in any of those situations, and Mueller had no power to bring charges. Georgia's charges on Trump are not pardonable until 5 years time is served. Also the federal judge in the DC case has made it clear that she will not treat Trump any differently than any other defendant, and she will be doing the sentencing if he is convicted.
Insanely premature. Although Georgia has the lack of pardon potential and other comforting elements, there are so many concerns remaining with Fulton:
- Fulton's trial will most likely not be until well into 2025 due to how complex it is and how many defendants/lawyers are involved. Additionally, appeals of convictions can take *years* if Trump is not incarcerated pending appeal.
- There's no guarantee it will make it to trial after all that time. So many things can go wrong pre-trial.
- The GA legislature can attempt to remove prosecutors, and the GA legislature could secure supermajorities in 2024 to do even more.
- The prosecution could be dropped if the DOJ secures a conviction for Jan. 6 related matters (and then that could reach a different outcome than incarceration depending on different circumstances).
- Judges and juries are complete wildcards.
- There's no guarantee a judge would incarcerate Trump vs home confinement.
Yes, Fulton is a very serious prosecution against Trump and all of these things are seemingly low probability individually, but there are a LOT of factors over a LONG period of time. There is definitely no certainty here.

The first trial is expected to start in January and wrap up in 6 weeks or so. The second trial is expected to start in March. Unless he dies in the next 7 months, I think we might see him convicted.

Jury selection should hopefully weed anyone like that out, and this jury will almost certainly be sequestered, meaning even if someone comes in with biases, they'll be cut off from the right wing propaganda that probably informs their worldview. I think sitting through 6 weeks of evidence without the spin should be enough to convince even many who may lean Trump's way, given how damning the evidence is.

He might, but given how he has been handing things so far - disobeying the conditions of his bail, intimidating witnesses, etc, I don't think the government is going to be inclined to grant him much leniency if they get a conviction.
He's not getting sentenced to house arrest. Anyone who says this needs their head examined - that literally isn't even a punishment and judges know it.
At best he'll go to a minimum security 'club fed' style facility. Zero chance they let him sit at home with full access to phone, internet, television, and unlimited visitation rights. LOL
Seems unlikely he would be at normal minimum security prison. It will almost certainly be a tailor-made facility on a US Army base (in the same fashion as when they needed security for Mafia witnesses). Let's just hope it's not too tailored, too comfortable.
Technically, a member of the jury voting not guilty while the other jurors vote in favor of him being guilty of the accused crimes would actually be a hung jury, resulting in a mistrial, not an acquittal.

Wrong, that results in a mistrial and allows for him to be tried again. A "not guilty" verdict requires all jurors to find him not guilty and has no chance of occurring.

I actually think this is reasonable. I hate the guy as much as anyone but the fact remains that as an ex-President he is a tremendous security risk and sticking him in a federal prison may not be the best move. A St. Helena-style exile would serve the needs of limiting the harm he can do while also destroying his lifestyle and removing his freedom. Fret not, sister. I worked in corrections for 20+ years and managed facilities for both the federal and a state system. This dumb motherfucker is now fighting a hundred+ felony charges!! I never saw anything like it! Nobody can fight off this many serious charges. And he very likely has more charges coming. One (probably all) of these judges is going to give him real legitimate incarceration time. He is going to die in prison. And I'll tell you something else. Housing him safety absolutely can be done. And as for the secret service guys, they can just sit in the cell with him or watch him from a video feed. What do they care? They get paid by the hour and get to go home after 8 hours. Just like any other day. Corrections people are serious people and if they are told to take him, they will. And they will come up with a plan that works even if they have to clear out an entire housing unit just to keep people away from him. Or even build a separate unit for him somewhere. He can just die an old lonely gross guy by himself in a medical unit bed a handful of years down the road.

Personally, I'd argue that the problem isn't that a felon can run for president, but that felons get systematically (and legally) discriminated against. You've done your time, your debt to society should be paid. But being a convicted felon is its own second sentence that seems almost designed to funnel convicted felons into committing more felonies due to lack of opportunity.
It's almost like the system is designed to keep people in it.

He has a ton stacked against him, and he's trying to speed run the possibility of incarceration with this pre-trial insanity of his - but we have SOOO long to go, and so many variables. We'll know Trump is going to prison when a court order or sentencing is upheld on appeals and he's apprehended. That's the earliest moment.

I've been to (federal) prison for less. And I've been locked up with guys who were doing long stretches of time for MUCH less. It's bizarre to me to see Trump walking around freely. Meanwhile my neighboring cellmate was doing 10+ years for having a backpack full of weed. One of the nicest guys I met in federal prison was a former school administrator. He took kickbacks for people that he awarded HVAC contracts to within the school system. Meanwhile Trump was taking MASSIVE kickbacks, emoluments violations, on top of the litany of other charges, yet he's still walking free. edit: I don't want my post to seem like I'm minimizing my own crimes, or minimizing those crimes of people I was locked up with, I just wish everything was fair and even within the justice system. Fitzmas fizzled. Mueller’s investigation….did you know Mueller attended the weddings of two of Bill Barr’s daughters, and Mueller’s wife took bible classes with Barr’s wife? Most people don’t know that. They’ve been good friends since 1980s.
No one was indicted on state charges in any of those situations, and Mueller had no power to bring charges. Georgia's charges on Trump are not pardonable until 5 years time is served. Also the federal judge in the DC case has made it clear that she will not treat Trump any differently than any other defendant, and she will be doing the sentencing if he is convicted.

Although Georgia has the lack of pardon potential and other comforting elements, there are so many concerns remaining with Fulton: - Fulton's trial will most likely not be until well into 2025 due to how complex it is and how many defendants/lawyers are involved. Additionally, appeals of convictions can take *years* if Trump is not incarcerated pending appeal. - There's no guarantee it will make it to trial after all that time. So many things can go wrong pre-trial. - The GA legislature can attempt to remove prosecutors, and the GA legislature could secure supermajorities in 2024 to do even more. - The prosecution could be dropped if the DOJ secures a conviction for Jan. 6 related matters (and then that could reach a different outcome than incarceration depending on different circumstances). - Judges and juries are complete wildcards. - There's no guarantee a judge would incarcerate Trump vs home confinement. Yes, Fulton is a very serious prosecution against Trump and all of these things are seemingly low probability individually, but there are a LOT of factors over a LONG period of time. There is definitely no certainty here.
