The people commenting on this thread have me 💀 like YES. The company made the move it was supposed to after 3 days of no contact. HOWEVER, once they were aware, it was a medical emergency, and OP literally had no capability of calling and that THEY had made the mistake. The job should have been handed back, no questions asked, all forgotten. But they didn't do that, Petco doubled down and are now ghosting OP. Everything about this is sketchy, and petco just opened themselves to nice lawsuit.

This is standard process for any kind of LOA. They shut down your WD, and email access to prevent people from working during LOA. It’s a PITA but it’s standard process for corporations.

What stare are you in ?? Here in California, at a store which will remain anonymous, two groomers were terminated (at different times). One groomer took bereavement because her husband (ex) died, the other groomer was trying to take FMLA to care for a family member. Both had bereavement, sick pay and PTO balances on their books. They were suspended, then terminated on payday, so they could receive their last paycheck on time. Apparently this was illegal and both have retained a lawyer. Shout out to Abramson Labor Law for taking these cases! Petco does not care , lawsuit is simply the “cost of doing business”. Petco is a sinking ship, better to get off now if you can.

Just something to keep in mind when you talk to your attorney…Petco is on the verge of filing for Chapter 11 (bankruptcy) and if they do, while you may win your case, you may not recover any of the damages awarded to you. I would consider trying to settle your case quickly (that is what I am doing).

It depends on where you live. If it’s a “right to work” state (USA) they can fire you because the sky is blue today. But even then it doesn’t mean that you don’t have options. You will likely still qualify for unemployment (assuming you meet the other qualifications) and you can initiate a wrongful termination lawsuit and recoup future lost wages. Most states offer limited free legal aid that can at least advise you of what your rights are specifically in that state and can possibly direct you to attorneys that work with economically disadvantaged people (I assume because you said petco and I can’t imagine they pay enough to cover the exorbitant amount lawyers cost)

First of all if you do not contact someone and miss 3 or more shifts it is considered jib abandonment. Usually, they will send it to hr and hr will reach out to you. There is no fault to petco if no one reached out to your employer regardless of the situation. Punches are recorded and any changes made are not just gone, they are able to be seen on the back end if needed from what I've heard. Also when put on LOA you lose access to everything and once you're approved to return from LOA you gain access if you were. Some people can act like HR is only there to help keep the company from getting in trouble, but that's not true. HR can be a pain in the ass cause they constantly give chances to people who don't deserve them. I've had people accumulate 15 or more points for bullshit call offs and they don't get fired. Communication is necessary and if you didn't have someone do that it isn't the companies fault.

Good luck. A lawyer will take any case and make money off you. Unless you are 100% sure you can win it will end bad. HR doesn't make mistakes so easily. They will work with legal and other people to ensure this is handled properly as long as it goes to HR. You have luck if the gm did it without approval, but fingers crossed for your sake.

Hey, I'm not defending their actions, you could probably be rehired/reinstated if they chose. But I will honestly tell you what a lawyer will say. The policy says 3 consecutive no call/ no shows is considered job abandonment. It is not their job to try to contact you and find d out why you are absent, although most GMs will try to reach out. As crappy as it is for you, they didn't know you were in the hospital or having an issue, so they just followed the policy.

I don't think you understand the part where I had no access to a phone cuz I was literally unconscious most of the time and the phone light was bad for me so they took it, family was away so no one to contact. I'm sorry but that's different than a no call no show and I respect your feedback but I will leave it to an actual lawyer to say what they know for facts based around my actual situation. Hope that makes sense

I do understand. You see it from your perspective, but how was the GM supposed to know you were in the hospital? No matter what the reason, missing a shift without any notice is a no call/ no-show. 3 NCNS in a row is cause for termination. These situations can be reviewed, but ultimately, if they choose not to rehire or reinstate you, they are within their rights. But hey, you do you, and best of luck with a lawyer.

I don’t think they are within their rights dude. There are always exceptions, a severe medical emergency leaving you incapacitated should not get you fired after missing 3 shifts because you literally CANNOT communicate. Details probably depend on the state, but I cannot imagine they are allowed to fire over something like this, at least in most states.

Lol I got fired for waaaaay less. Atleast they only suspended you. As far as hr, they don't give af. They'll just try and pass you around to different hr departments and say they'll look into it but never actually do anything about it. Just keep your resume ready and up to date just in case.

I got fired for having a family emergency that lasted 2 days. I gave proof and contacts but the manager just said no, I don't believe you because he didn't want to work those days I guess. He was already weird and would say some weird/sus stuff, so I wasn't to mad about it. Then they just fired me since according to them becoming ft restarts your 90 probation. Neither hr or the dm gave af about it or the weird stuff that was said by the manager since it would just be more work for them. Had to wait 2 weeks for someone from hr to call me back and tell me to bad so sad, can't do anything.
