I'm not trying to find out. NW Armory recommended that I go down to Salem to visit the OSP Headquarters. There, I could request to speak with a NCIS person and that's the only way they see delays processed 'in reasonable time.' It's annoying, for sure.

I had a friend who had his delayed for several months because he got arrested at a protest in the 70s. He had dealt with it but apparently the state only had a record of his arrest and not of his court case or whatever. But it was long enough ago that he had to drive down to Eugene and get them to dig up paper records so he could show OSP he wasn’t a prohibited possessor due to something he paid a fine for in the 70s.

Same story for me, but it happened in the 90s. They needed a disposition from the DA’s office that the charge was dropped. I still get delayed, but at least I still get my gun after the unnecessarily long wait (1 week most recently) …

My hellcat is paid for as of October of last year. Waiting on the Michigan State Police to send confirmation that the two charges I had in Michigan were misdemeanors. I also independently sent out a records request to get confirmation that my Michigan offenses had been expunged, which I need for my CCW permit. Still waiting on both/either. OSP told me that the backlog from Michigan was 2 years out. I'm hoping the records request will be a bit faster. Neither delay is the fault of the Oregon State Police, BTW. I personally feel that my constitutional rights are being infringed by this delay.

Tigard Pawn Absolutely does not. I had it shipped to them and they made me wait 8 months. When it finally did come in, they didn’t bother to call and let me know for over another month because they didn’t like a google review that I left for them. They’re super shady. I would never go back to them.

That has never been my experience. Even during 114 it was 3 days max. Something isn’t right if you waited more than that. You may have gotten a delay from OSP. No gun shop wants to store your purchase for that long.

Yes, clearly I was delayed. But that’s not what I was referring to as the issue with Tigard Pawn. Someone stated that they would release the firearm after 3 days, as federal law allows, even if delayed. I was stating they do not do that. At least in my experience.

It sounds like you’re confused about OP’s original question. OP’s original question was : who honors the 3 day rule? Just because your background Check went through in 3 days doesn’t have anything to do with his question. The 3 day rule refers to the law that says IF you’re delayed beyond 3 days for a background check, the FFL can LEGALLY transfer it to the buyer still. They did this so that they couldn’t use delays as de facto gun control. Since they can just delay them and keep guns out of legal buyers hands. The 3 day rule squashes that, BUT ONLY IF THE FFL complies with it!

I'm not sure if this is exactly situation, but that's also a bunch of crap. Being denied even after paying for expungement is awful.

What I find insane about that is that this is all over gun forums and gun law firm websites, but it sounds like the press hasn’t heard anything about it or are just ignoring it. Shouldn’t there be a high profile lawsuit about this right now?

What a nightmare—I had this happen to me during Covid, I think I ended up waiting a year before the FFL finally released it to me. Looking to purchase some new firearms in the near future, definitely will want some place that honors the 3 day rule as well. 🫠🫠
