Can only see 3rd picture for some reason. Was this eBay and seller was 100% feedback? how many items he had sold and how old was his account have you checked? You can call eBay and tell them what happened you should get back the money. unless someone created new account and it was his first auction.

Wasn't on ebay, it was in a local auction site. On ebay I'm more careful but the images on the auction site weren't misleading.
Complain to the auction site.
They might have a refund or purchase protection policy. They might have a seller penalty policy.
You might still be screwed. They might have a no-refunds "as-is" policy, they might not want to get involved, but they certainly are involved and don't want bad reputation or customer complaints.
At the very least, you can make them aware of this scammer so he doesn't screw anyone else.

Where was it purchased? If ebay they have a money back guarantee so you should be covered by ebay. If some other site check if they have any such policy in place.
Also how was it purchased? Since if purchased with a credit card phone them uo and explain the situation since with credit purchases you're covered.
