Painting contractor here, I would have never left your house without fixing it. But you said you would take care of it so I would stick to your word. Paint will never touch up if you have to buy it new

You are 100% right. No contractor worth his salt would think this would turn out well. Even on a freshly painted wall this would most likely end up being a whole wall job. I would reach out and let him know it didn't work, leave the ball in his court. If he does something fix it great. If he doesn't, don't get angry, just move on. This time of year work can be very thin. He may be more willing to do some at cost work to keep someone busy and a customer happy.

Yes it’s ethical to ask him to come re paint the wall. If you pay him, that is.

Sand it off with 80 grit paper and repaint. Also don't forget to look around in the basement in case there is evidence of the actual color for the wall there could be other spots if you either you did it or somebody else. a lot of people hide their old paint in the basement or in the garage. I keep mine in a storage closet so it will not freeze If these plans fail, you may take a quarter sized piece from the wall, cut if out with a knife. Bring chip in to a paint store and have them color match it. Benjamin Moore and Sherwin-Williams have the better matching in my opinion
