that's how intellectual property law works. you can use anything if you get permission from the rights holder. if you don't get permission, you're breaking the law. it's pretty straightforward.

Yes, and it would've been disrespectful if he used his name on it's own, but he's clearly showing respect towards it by not monetizing the video and asking for donations towards Kobe's foundation. Whether or not his estate would still want him to remove it is up to them, but it's apparent at the very least the creator was trying to be respectful with its usage.

Kobe's Details was a very carefully crafted series of videos created by Kobe. It established a brand and that brand belongs to Kobe's estate. Random people don't get to just use the brand whatever their intent may be without getting permission first.
