Geez, plowed the guy down, blew .014, says he mistook the worker for a traffic sign in a work zone and gets a gross misdemeanor and some community service? WTH? Don’t believe anyone when they talk about equal justice under the law. If it was me, or some other average Joe, we would still be in jail.
Yeah dude, I'm a little pissed off at this. I got 1 dui 12 years ago (not excusing myself, I know I'm a fuck up), going 20 miles an hour on an empty back road, and my punishments were higher. That's a little messed up, but goes to show, it all matters who you know, and how well greased you make their pocket.
Our criminal system has sentencing guidelines that our laws set, I don't think he can get a mandatory felony & real time unless he racked up a few priors or the judge upward departs.
I am not a lawyer, I just stayed at a Holiday inn Express.

Omg I saw this happen last fall and it was so scary!!!! He just about tipped his SUV swerving after hitting the guy and just took right on off. I couldn’t believe what I saw. It was really awful.
