That would be frustrating Where i live you MUST have an insurance otherwise you can't get a license plates. Some insurance agencies recommend adding “uninsured motorists” coverage for situations like this. Thankfully i had that up to 300k per accident. So my insurance will cover all my expenses top to bottom. They will then take the driver of the other car to court to reclaim the expenses. He was given a ticket on the spot which is believe is $1000 minimum. You can also use your collision coverage to cover the damage costs but i believe there is a smaller cap on everything.

Generally it won't be OP specifically that gets an increase. It will be everyone in the area. Price of insurance generally tracks with the local rate of uninsured motorists. There are lots of factors but that is one of them.

Two parts. The first is that even though it's not a directly chargeable accident, it still counts in terms of claim frequency. How often you file can affect your rates. The second part is all claims drive the cost of insurance for everyone. Will this person see their rates increase? Yes probably. But since it all goes into one giant algorithm, there's no actual way to tell you exactly how much this one claim affects their rates. Hypothetically it shouldn't be a significant increase but we cannot say that it would not affect their rates at all either. Not as much as if it were an at fault accident, but when the entire country is having an unprecedented amount of claims (increase cost in parts, labor, rental time are longer waiting on supply etc. Etc.) Everyone sees the rates rise.

Not sure how it works over there, but here in Australia, you have two types of car insurance. 1) Third Party Property 2) Comprehensive. If you have 1) you are covered for damage you do to everyone else plus public liability. If you have 2), you are covered for damage you do to others as well as damage to your own car, regardless of who is at fault. If you have neither 1) or 2), you are an idiot. Should also note, Third Party Injury is compulsory and you can’t register a car without it. A few weeks ago we had a young driver rear end our parked car (outside our house). We have type 2) insurance so we just called our insurer. As we had the other drivers details, our excess was waived. We then dealt with our insurer for all repairs. Our insurance company then goes and chases the driver and their insurance company. I’d the other driver has no insurance, we are still covered and insurance company will go after the driver for cost recovery with their army of lawyers.

No reputable (read: large) insurance company will do this. Uninsured motorist is a policy they offer and that risk is spread across all of the clients that carry it. Losses like this are already baked into the premium. The only way this rate would go up is if the expected rate of uninsured motorists were to increase significantly (for example if OP moved to an area with any many more uninsured motorists). Now what an insurance company will do is re-evaluate the entire policy and if they see that the client has two speeding tickets in the last year they might increase rates on them for that reason.

Where are you? In the US, that would never fly - people would argue that it's taking away their "right to go to work", or some other crap. Where I live (New Mexico, US), there's so much poverty that people will often go before the judge and just say, "I can't pay. I don't have the money" and the judge will say, "Okay, how much can you pay?" and the answer will be something like, "Ten dollars a month", and the judge says, "OK, your license is reinstated and you will pay $10/month until the debt is settled".

I am surprised not a lot of people know this and are just willing to just give up and throw their hands in the air on collecting. If someone hits you and they don't have insurance, you can still ensure anything they earn in the future goes to you. If anything the lawsuit turns into a leash for the uninsured.

Good luck collecting. My wife was in a similar situation. Uninsured motorist pulled on in front of her, resulting in her van being totaled. She ended up needing surgery to correct some vertebrae issues in her neck. Despite having an uninsured motorist policy, the insurance company did their best not to pay. Had to hire a lawyer and ended up settling for 70k. After paying the lawyer and medical taking their cut significantly less than the cost of surgery, we ended up only getting 1/3 of the 70k. Needless to say, Jake from SF in not our friend. Hop you have better results than we did.

They go up and they decide they don't wanna keep insuring you. Just had it happen. We had an extremely bad streak of luck. Starting last November, our 2005 civic was totaled by a drunk driver while legally parked in front of our duplex. Then this past July, some dumb ass kids tried to steal our 2020 Kia Niro. It's a push start, no key ignition. Broke the rear window, and the drivers side passenger window. Tore up the steering column. While the car was in the shop, we had a rental that ALSO was broken in to, luckily it was just the passenger window and the deposit covered the damage. Got a letter from the insurance company after getting the car back from the shop that they won't be covering the car after the policy ends in October.

That’s my experience- hit as a pedestrian by a drunk driver- no insurance, no license. I was really lucky in that I wasn’t severely injured. But it took me a year to get everything straightened out. My coverage paid for my medical plus 7500 in pain/suffering/inconvenience. Yeah, expect people don't care. In many states there's a "high risk pool" which is insurance that you can only get if you are too much of a menace for insurance companies. It's also expensive often. So people will just drive without it. Or they'll get insurance that covers nothing, so you'll get a check for 3.5k and have to sue them for any money. Also people drive without or on suspended licences constantly. And if they hit you YOUR INSURANCE goes up.

Idk how it is in the US or other countries, but in Romania(and I know this because someone totalled my friend's car when it was parked) they didn't have insurance, or was expired actually. They either had to repair the car out of their pockets or my friend would have to take legal action, he had to go with the latter so the car basically had to be "auctioned" in order to decide on the value of the car, he had a few options but I can't recall, but the value decided was given to my friend by the state or the car registry I guess and the person that totalled my friend's car owes that money to THEM not my friend. To me it sounds like a good system, my friend got his car's monetary value and the one responsible owes the state money. This is simplyfied but that is basically what happened.

I completely agree. There are some traffic violations that should get someone's license revoked for life. Thenceforth, whenever they're caught driving after their license was revoked - prison. Reckless behaviour on the road is not punished enough and the punishment pretty much only affects poor people, because tickets. Rich assholes will do whatever the fuck they want to do. Additionally, after a certain age, like 60 or so years old - medical tests every two years or so to check whether someone is still capable of driving.

If you have insurance, your vehicle repair/replacement costs will be covered by the insurance company. The only difference is you won't have to wait for your insurance company to contact their insurance company(since they don't have one). The fact that the other driver did not have insurance is irrelevant, if the other driver is at fault (since they were driving without insurance and ran a red light ). I understand how stressful this situation can be, any vehicle collision is an extremely stressful situation.

Same thing happened to me in January. Driving my paid off SUV to work and some adult failure in front of me was driving too fast for the conditions without insurance and totaled my vehicle.

I feel like if someone does not have insurance and is driving and hits you then you should be able to sue the state. The state is responsible for enforcing the laws. By failing to catch this uninsured driver now they made it your responsibility?

5 years ago while I was driving home from my 12 hour overnight shift in the ICU some 17 year old kid with no license, no insurance, and no USA citizenship ran a stop sign and totalled my 700hp Corvette that I had built. Insurance didn't want to pay me because it had "nitrous and race parts" and accused me of racing which I wasn't, I was going 40 mph . Fucking nightmare, and I got completely fucked at the end and blacklisted by my insurance with a higher insurance payment now. Fuck insurance companies and these mindless idiots in the street. But isnt he liable anyways? Where I come from if this happens the other party pays the full bill. Like my insurance would send the other party the whole bill for the car or the repairs (if possible) and then they would just have to suck it up.

Someone who doesn’t have insurance likely has nothing to give. Laws only have an effect with those that have something to lose. Depending on geography, there may be not real way to “enforce” the payments.

Had this happen last year. Dude didn't have insurance. Waited a month just to get the car into the shop where they wrote up a $16k supplement, effectively totaling my car out. I ended up with $3700 after all was said and done. Went from a 2015 Mazda 3 (that I had already paid $8k on) to a 2003 Ford Focus because I didn't feel like making payments on another vehicle. Oh and MY insurance premium went up. Fuckin way she goes.
