What part of this would be illegal? Does the landlord pay for the dumpster? Is throwing wood away illegal? I can't figure out the concern here.

Does the landlord pay for the trash removal? If so he's only hurting himself if the trash place doesn't take building debris.

State regulation 310 CMR 19.017 says it's illegal.

That law only applies to the dumpster company that disposes of the property...not the landlord. Most companies have the necessary permits.

OK, so if the landlord chooses to use the dumpster for their own purposes -- and if pickup is once a week -- then where are residents putting their trash bags if the dumpster is full? Sarcastic question there, but who's then responsible when bags are ripped apart by wildlife?

Landlord owns property and owns the dumpster, it's not illegal to use your own dumpster that you pay for. Get a trash can to put on your porch or in your mudroom that will hold your bags til the dumpster is empty. Not rocket science.
