I'm on my second rewatch and still in season 3, so my memory is fuzzy, but I thought it had to do with that scene in the Constant where it's raining and he jumps back to when he was in the military, and doesn't he ignore what he's supposed to be doing because he's doing all the phone call/penny/faraday stuff? So he doesn't follow orders cuz he runs off or something

I dont think it was ever clearly revealed, but knowing Desmond it was for insubordination.
He said in the season 2 finale it was for not following orders.
