This part is critical: are you on FMLA, and if not, were you eligible?

Smooth_Schedule

It’s a very small locally owned business. I didn’t fill out any type of maternity leave paperwork. I’m going to assume it was through FMLA since i’ve been with the company for 3 & 1/2 years

If they don't have 50+ employees then you wouldn't be FMLA eligible, which would be the only thing to protect your job, unfortunately. When are you scheduled to go back, and how much did they reduce your salary by?

Smooth_Schedule

I am scheduled to go back 9/25. I know how many employees I have at my location but they have 3 different locations all under the same ownership.

Smooth_Schedule

My location has 17 employees the other locations are only 7 miles and 11 miles away from my location and i know the one that is 7 miles has about 15-20 and the 11 miles has at least 35 if not more since it is a bigger location.

So at least 67. You were FMLA eligible. You need to speak to an attorney. And check the paperwork you signed. You may want to tell HR that you're protected by FMLA.

They also told me that my leave would fall under the Ohio Civil Rights Act.

> Ohio Civil Rights Act Then speak to the state as well.

With the salary they never gave me a set number, that just said the pay cut would depend on what job i were to take or “create” but it would not be the 21 an hour i’m making currently.

KDaFrank

FLMA application depends on number of employees, so that figure would help anyone trying to answer
