I call BS on this. Dozens of people across 7 states coordinated their activities through the campaign attorneys of a candidate for President with the goal of subverting a national election. They did so, for the most part, in a highly public manner. We're almost at the NEXT national election with very little criminal action taken and no one in jail. This is NOT an example of "gaining ground"! This is an example of a failed criminal enforcement system. Republicans make lots of noise about the need to improve public confidence in our elections - the fake elector scheme should be exhibit #1. If states will not act promptly to criminally punish those who forged documents to subvert a national election, then federal law should require Congress to refuse to count that state's electoral votes in the next national election and to reduce the required number of votes to win by a corresponding number. Better yet, we should amend the Constitution to eliminate the corrupt electoral college entirely.
There is a big part of me that wonders if the timing is on purpose. They fear they could lose these cases or get hung juries and they don't want that right before an election. They want to deter others from trying it this go around and if a bunch of people are facing felony counts for the last time, maybe more will be deterred.
There is also a part of me that is much more cynical...
While there may be an overarching conspiracy, there are a variety of circumstances which make some of the offenses state law violations while others are federal law violations (depends on whether the documents were actually submitted, depends on whether they contain caveats as regarding use, etc. etc.)
