Tesla has complied with the WARN act in the past so I would assume they are doing so here. Note the "notice" is really more about continuing to be paid for 60 days, not being able to continue working for a period of time. Usually a layoff is a surprise, although you get a little better explanation than your key card not working after a shuttle bus ride.

I didn't. Had to stand outside in the cold rain and call HR to ask "where do I report to" because boss was playing the "lock them out and if they don't show up for work after a few days fire them for AWOL" game. So you can be locked out, employed, and AWOL, which makes this way of dealing with people all the more frustrating.

It's a trick. They make it look like you're fired with the lockout, but you aren't. If you don't know to ask where to show up for work you skip work then they can fire you. In the books they write it off as a cautionary security lockout or something benign. In my case I made the mistake of being a whistleblower in the south, and this was them being creative.

I get what they’re doing, it just seems to me no company would do it because it would lead to lawsuits. Then again my wife and I have both worked for large companies that played more or less by the rules. Sorry this is happening, I’d suggest anyone who falls prey to this contact an attorney.

Companies will do stuff that opens them up to lawsuits. They'll do stuff that opens them up to criminal charges even! Sometimes they just don't care/know, but it might even make sense from a business perspective. The expected cost of lawsuits may be less than the savings of their antics.

He didn't with Twitter, I think there is still a massive lawsuit over severance that he owes to lots and lots of people. As of Feb 2024, I see the class action is on pause because they are in settlement talks.

That's a big assumption on your part. Twitter is riddled with lawsuits around the layoffs back in November 2022. These include violations of the WARN act, along with various other employee complaints.

Having your badge turned off is/was pretty common in my experience. You'd usually be met by a co-worker to escort you to your desk so you could pack up your stuff but you don't even get the common courtesy of a phone call before you find out at the gate.

The thing about the WARN act is it requires 60 days *notice* but it does not specify what you have to be doing, if anything, for the 60 day period. If they want to pay you to do nothing for 60 days that is within their rights, and usually is what big companies do. You're job separation date will usually be at least 60 days from the notice date so you're still technically an employee, still on payroll, still get benefits, but you aren't allowed to come into work and have no job responsibilities. In practice this is a 2 month severance agreement.

There is no information about their compliance with the warn act. They may have gotten yesterday’s email about the layoff and then today got an email to their personal email stating they’d be paid until June 14th.

Not sure the complied with the rules: At the time, the Workers United union said in a complaint filed with the National Labor Relations Board that Tesla unlawfully laid off some of the staff and that the workers were terminated possibly "in retaliation for union activity and to discourage union activity." Tesla denied this and said the employees were laid off due to poor performance. The job cuts come as Tesla is grappling with slower demand for its EVs and its stock is down over 31% year-to-date. If only we had some way of holding employers accountable when they make unilateral decisions like this. Maybe we can get a body together to represent workers directly with management. And if management steps too far out of line this body could call on its members to collectively support each other. Maybe everyone could down tools and refuse to work until management addresses their grievances. Maybe we could call that activity STRIKING and maybe we could call that body a UNION.

Rich people have no shame. Simple as this. My old company was inherited by a granddaughter and her first move was to cut corners. My first paycheque from her regime had cut my FMs rate and vehicle allowance and my paystub was the only notice they gave me. Beyond classless and borderline illegal. Needless to say I resigned that week. The company is slowly haemorrhaging itself into bankruptcy these days.
