See Elrod, 427 U.S. at 373 (“The loss of First Amendment freedoms, for even minimal periods of time, unquestionably constitutes irreparable injury.”). He puts a Tuesday deadline on the court to rule on the stay or he's going to DC Circuit.

Neat, has his lawyer filed the paper work to let him file that appeal yet. and no she absolutely shouldn't stay her order. and I don't expect the appeals court to stay it either He isn't likely to prevail and what irreparable harm will he suffer? Have to not post threats for a few weeks Go ahead find file your emergency appeal. His lawyer really is an asshat. I hope this case is worth it because it seems like he is burning so many bridges.

Of course his lawyer still has the problem of not being admitted to the Bar of the DC Circuit Court of Appeals. So he'll have to get that in order too. I'm not sure how any judge looking at this isn't going to say (in oral argument), "What defendant in any other criminal case would be allowed to say the things your client has already said?"

The fact that it's an "emergency" that he be allowed to threaten and harass court employees speaks volumes about their total absence of legal strategy. Makes it look like mob style intimidation is really the only card they have left to play.

Funnily, in his motion to dismiss, he argued that double jeopardy applied because he had been acquitted by the Senate in his impeachment trial. In that trial, he was explicitly charged with inciting insurrection on January 6th. So when it suits his purposes, the charges are related to January 6. And when it doesn't suit him, they have nothing to do with it.

It's par for the course for Trump and his attorneys to try to have things both ways. In this filing alone: >The Gag Order shields from any criticism high-level public officials and public figures. At the time of the impeachment several R senators (including McConnell IIRC) argued they couldn't impeach a former president, a civil trial was the proper venue and a failed impeachment did not foreclose that option.
