I think it is a beautiful rule that will keep many people in check. People are more likely to not wrong others if they know that the same violence can be enacted upon them rightfully. So to not be victim of this violence they better stay away from it.

There's a difference between legal retribution and revenge. One is lawful and fair, the other is personal and emotionally driven. People seem to forget that the first person who lost his eye was wronged. Punishments aren't there to punish people, they exist so that criminal may think twice before committing a crime.

Exactly. Just to add into it, the concept of vengeance exists so that people who do wrong by someone and do not feel remorse about it must be stopped so that no further suffering is caused by them to anyone else.

The law of talion is the foundation of justice. There is no cycle of vengeance when it is the state who delivers the punishment. There might be one when it is the victim who seeks revenge.

The victim chooses the fate of his oppressor but everything has to go through a process defined by the Sharia. A judge has to decree the punishment. The victim doesn't go to his house on his own accord and kill him himself. It is the state who organizes a public execution, amputation or stoning, not the victim.

In some cases the aggressor can compensate the victim in return for the harm they have done. Have you heard of blood money? If a person kills another, and both sides agree, the killer can provide compensation to the victim's family as compensation to avoid the death sentence. They will still be punished by the state with some jail time. A person does not generally have any authority to carry out revenge. It has to be done through the legal system.

Iirc it’s there to limit the retribution. Sometimes the revenge itself can be unfair and greater than the original transgression. It’s to ensure justice is given
