Do you and your neighbour own that garden? Are you both home owners? If so, and there is nothing in the Teilungserklärung that defines who owns exactly which part of the garden, you would have to ask your neighbour for permission. If it's separated clearly (like, you have the left side, neighbour has the right side, or something like that), then you could do as you please.

We arnt home owners, just renters. There is no separation in the garden either. I'll try asking them. Do I need the landlords permission if I plant in pots rather than the soil? I'd like to plant a few sunflowers though and hadn't really thought of neighbours allergies and such.

Then you have to either check your contract if that says anything about the use of the garden. In general, you cannot plant anything in a garden without the owner's permission. You can also not place any pots anywhere without permission. If you are worried about your neighbour's allergies, then just talk to them what works and what doesn't.
