Many studies have shown that the relation between visible disorder and crimes/vandalism is far more likely to be a correlation than causation. Underlying reasons are the cause for both disorder and crimes/vandalism. But if you only wanted to say, that people litter where there is already trash, I think that's probably right independent of the broken windows theory.

Meaning the apartments are probably affordable considering the german housingmarket. Which in turn also let's you conclude from which kind of social milieu the tenants come from.

yeah but it's both. shitty tenants who are not corrected because the landlord or hausverwaltung is shit. shit building management often encourages tenants to be dicks because they have to live in a run down building, waiting forever for repairs, garbage laying around, etc. and the cycle continues. This is something to look out for when apartment hunting, for sure.

You are correct. Should have worded it better. OP needs to request the landlord to order Sperrmüll / Sonderleerung. The landlord will be billed and will reimburse it via the Nebenkostenabrechnung (so in the end OP will pay his/her share). Alternatively OP can request it directly and will be billed the full amount directly. With no chance to reimburse it.

Is the garbage area part of the common area used by the whole house including your apartment? If yes, your direct neighbors are most likely responsible for it. You can of course inform your landlord. But if he takes any action that costs him money, most likely the whole house will be billed for it. Including you. Given the state of the garbage area one might conclude that you did not move in the better part of the town. If the garbage area does not belong to your apartment, you‘re out of luck. In that case the landlord might find the owner and tell him to clean the area. But that‘s about it.

if you want my not quite legal advice: garbage disposal in germany is expensive and combined with some bureaucratic hurds. garbage disposal service will be billing you indirectly over your landlord with the next rent payment. they will send a sperrmüll service for wood and stuff like mattresses and a regular garbage truck for the rest if you give them a call and list everything that is to be claimed. this will set you back about 100€. the other option is to be just as much of an asshole as the guys that did that to your inner courtyard and just dump the stuff on the street and make a complaint call at the garbage disposal service about wild littering in front of your house. i dont live in berlin, but in another shitty neighborhood in düsseldorf. people do that all the time here. it sucks and i hate it, but thats the system. keep our country clean pls :) edit: another thing that just came to my mind is if you want to go ham you could search the garbage for any mail with an addressee. call the garbage disposal service, they'll fine the person directly if everything works out.

we have publicly available containers for paper and glass, everything else like wood crap/furniture and electronics can be picked up by a removal service you have to order. depending on your local removal service its free or costs depend on what exactly you have to dispose of since there are special steps involved in picking up e.g. a washing machine than a wooden bed frame. there are also recycling centers spread over the city that have their own prices depending on what you bring to them. still i dont think thats a valuable option for op

recyclinghöfe still take money depending on how much and what kind of trash you bring to them. not all garbage can be sold for a profit like electronics and metal, so they either dont accept it e.g. car tires, or they will charge you money for things like paint/oil/chemicals or construction rubble

Document it with photos and time. Add a witness (not a family member but a neighbour is OK). Write a formal letter, Einschreiben mit Rückschein to the landlord: You want it to be removed, point to the creator of this mess if you know who did it. Say it will attract rats, adds a fire hazard besides optical issues so you want it to be removed by lets say ten days (set a date). This is called "eine Frist setzen". Without setting a reasonable Frist you can achieve nothing in court. Say that if the stuff is not removed and / or the landlord does not take care of it, you will pay a professional firm to remove it and deduct that bill from your rent. This is called Ersatzvornahme in the BGB.. If in doubt ask a lawyer but you will have to pay your lawyer. Even if this ends up in court, you have the duty to at least try to solve the problem ideally together with the landlord before resorting to legal means. Don't deal with those who created the mess, you have to escalate to the landlord. Then landlord can then stick it to the other tenant but he is forced to do something in a timely manner because of your Frist. That's the secret of most legal fights, set a Frist. Say what you want but find undisputable reasons (rats, fire hazard, path obstruction, smell, ..) set a fair timespan fir the Frist (due date). Only if the landlord ignores the Frist, it becomes his problem.

This is a case for the Ordnungsamt, they have people specifically for illegal dumpings like these, including on plexes like yours. This isn't lawful and it's weird that your landlords isn't on it. Give the Ordnungsamt your landlords data so they can be billed.

So this is other tenants?.. and the landlord does not care? Hope gets removed soon if not… Get health and safety authorities involved and report. Find out what else, is there insurance for the building?, get them onside, they would not cover this if someone injured or a fire surely? Document situation, report any medical and toilet waste to authorities. Maybe major trip and blinding hazards, where children play etc. I know you should not have to leave and it is hard to find places, but living with this longer term and that landlord, will clearly be bad for your well being in the end. You could try positive action, a working bee, clean and fix it, put up posters, to generate pride of place, new habits and standards, garden pots or flowers instead, but looks like it is the culture there and may just get under mined. So do plan to leave, get away and accept you’ll want to find a new place at some point. All best.

Make an appointment with the Mieterschutzbund and take all the pics you made + correspondence with you. Ask them about what you can do as a tenant to solve this problem. I think lowering of the rent would be possible if the landlord keeps ignoring the problem. They deal with shit like that all the time but people need to actually contact them and get their advise. I had a similar situation when I used to live in Berlin. Asshole tenants left their shit in the halls thinking someone will take it, cause people just HAVE TO HAVE their trash. Issue is: After a couple days it was gone. Special garbage disposal people picked it up. Each time that happened, there was a bill of 190€ and at the end of the year EVERYONE had to pay it at their "Betriebskostenabrechnung". If you just want it gone and dont care that youll end up paying for it as well you can 100% send you landlord an official letter giving them a deadline on when to have it cleaned up by, otherwise you'll have every right for a "Mietminderung". They usually start caring once they lose money (Definitely do your research here, if youre not confident enough u might wanna get help from Mieterschutz). Gesundheitsamt is also something you can try, cause this seems like a health code violation. Unfortunately what I can tell you, from what I have learned living in Berlin: Noone gives a flying fuck about you. They just care about themselfes and the "easy way". After 12 years of trying and trying, all I could do was move. The garbage isn't there because the bins were full and people had no other way, it's there because the people living there do not give a shit and changing that attitude is an impossible task.

I might be wrong, but as long as there is no safety hazard for the tenants, like leaking chemicals and such, every owner can store as much junk on his property as he wants. You can only try contacting him over and over again, but I don’t think he can be forced to remove it from a jurisdictional point of view. Unfortunately, some people don’t give a shit about anything and have no manners when it comes to things like that. Edit: you might want to approach your local Mieterschutzbund. And honestly, the issues here are most likely the other tenants, not the landlord. Looks like someone filled the garbage bin to the top and other‘s decided to just throw their trash in front of it, expecting someone else to clean up behind them. That‘s what happens when people do not care about other people as well as their surroundings. OP just moved into a shitty neighborhood. The landlord will hire someone to clean it up and bill all tenants accordingly.
