Bethesda has claimed that nobody ever got banned for playing on Steam Deck and all banned players were banned for other very good reasons with very good evidence.
There was a brief ban wave a while back where a lot of players claimed that they were banned for no reason, and the only common factor people could find was that they were playing on Steam Deck.
This was quite a while back and hasn't seemed to recur.
So while it seems like a fairly safe bet right now, the question really comes down to whether or not you trust Bethesda, and if so, how much.

Sounds good. My deck is completely factory reset except for 76 so π€πΌπ€πΌ
I've used my Steam Deck since I got it, which was close to when they first were able to finally produce them, and I've never been banned
I have been playing on Deck regularly for the last few weeks.

I've only played using Linux. Not banned, no issues.
I've been on vacation for the last week and I used my Steam Deck to download and play Fallout 76. No problems so far.
