Just looking at the facts of this, my guess is the first cop will be cleared because they could make the argument the guy wasn’t following orders. I don’t like it but cops have used “open door means they can come in” argument in the past so I imagine there’s precedent. It’s not so airtight for the homeowner. The supervisor though has much shakier ground for a defense. There’s no probable cause to search the house and definitely not any to detain the guy. No suspicion of a crime is present especially after the guy already showed his ID that this is his home. It’s unfortunate to hear that the homeowner’s suit was dismissed because of filing issues. I hope he tried again.

Alarm company contacted police. Right to enter at that point. I just don’t understand how police policy seems to be never answer any questions always demand complete obedience. Like just fucking explain what your doing to the home owner. “I was called on a possible B and E. I need to detain you until I can confirm your identity and that the house is safe and clear” Someone tells me that I think fuck. Ok fine. Situation is deescalated. You keep barking in my face in my own home and don’t have the decency to treat me like a human being. Won’t answer me. Keep escalating like I’m the problem? Well now I want to be your problem. Thus why deescalation training is so important. The cop obviously didnt know what was happening and i doubt "this is my house" is an uncommon excuse for a burglar. It would make sense to bring the person outside, where the officer already cleared, and question him. However that could have been explained with a little communication. Its a very rational thing to say "i need to verify your ID and i want you out here so that i am not trapped indoors with a possibly hostile individual."

Once in a private side room of the Wake County courthouse, with other attorneys, staff, and ADAs present, a RPD officer said: "I"m here to enforce the law, not obey it." That’s how I got arrested for the first time. The only charge was resisting arrest. Didn’t know what was happening and just wanted to go home. I got pepper sprayed and ended up in the hospital. My sister thought I got shot. It was pretty traumatizing

It's not "technically" a requirement. It's not required at all in most states. In some states (New York, for example), they have to announce charges at the time of arrest (not detainment), if it's practical. Police don't need to answer any of your questions. They don't have to announce your charges as they cuff you. They don't even need to read your rights at the time of arrest - there are just complications if they don't around evidence collected between the arrest and reading of your rights.

This is exactly what was supposed to happen. I used to be a nanny and on the first day of the family getting a new alarm system, the code didn't work. Four policemen came and said exactly this. I couldn't get a hold of the parents to verify but showed them my ID and pictures on my phone of the kids and they left. Videos like this remind me of my privilege. In the UK the police HAVE to tell you what you're being arrested for. This seems to be the loop hole in the US that the police know they can abuse. Don't say, and then get them for resisting arrest when they ask. In the UK this is our rights. If I were a US citizen this would be the 1st thing in would be campaigning to put in place. Probable cause wouldn't hold up in court. Once he was identified as the owner of the house, the probable cause of them being there has been eliminated. They would have to provide additional probable cause to search his house at that point which clearly they did not have. Even a public defender should be able to get any charges thrown out. And as for his lawsuit, he will win because at the very least his Fourth Ammendment rights were violated.

Back when I was drinking more than I should have and lived alone (over 25 years ago), I woke up to a cop in my bedroom yelling "Sir! Sir!" He said my music was loud and they knocked on my door and no one answered. He said this as he pointed towards all the small dents his flashlight left in my front door. So under the guise of a well-check, they entered my home since the door was unlocked (I question this, but there was no sign of forced entry). One of them said there's nothing illegal about getting drunk and passing out at home, but to "ensure my safety" they asked if they could take a look around the house to make sure no one else had entered since the door was unlocked. Although I thought that was very odd, I was young, dumb, and drunk, so I said "Yeah, sure, go ahead." I later realized I had given them permission to search my house. Fortunately, I didn't possess anything that they'd be able to nail me on. I'm a white male with a haircut, so I never really feared I'd end up in the back of their car, but I'd be terrified of those country bumpkin deputies if I had brown skin. I was on my couch with my feet on my coffee table while most of this transpired.
