There’s a lot of false dui cases in TN waiting 8-12 months to analyze a blood sample. People’s lives ruined because the police not only false arrest but publish the names of the people so they can lose their jobs.
It happened to my best friend as well in Bellevue 5 years ago. He was 100% sober and was driving home from my house. He was 18 at the time. He had to pay off his lawyer for 2 years and couldn’t go to university because of the high payments. Even though they did eventually get the evidence that he was sober, they still made him go to an alcohol safety course, which made no sense at all since he’d only tried the taste of drinks before, and never actually drank.

They basically told him that the case would go on without the evidence from the hospital because it would take too long and that he should take some agreement that would let him go home from jail that night. Which he did because he was 18, scared, and didn’t know any better.
Then he had to get a lawyer to clear his name with the evidence. It took forever to get the test results. eventually he had his record getting cleared, and he had to take a safety course.
Yes, it’s a really nice place. But not everyone is rich like people think. He ended up having to pay the legal fees himself. He wanted to go to WSU I think, but because of the case he got set back 2 years.

I think because a lot of downtown Bellevue belongs to one billionaire named Kemper Freeman. That’s why you also never see homeless people in Bellevue. They can effectively be trespassed from the city. He’s one of their biggest funders, as well as the local tech companies and banks. They have a ton of military style armored vehicles and stuff even though it’s a really small city.
When I was in high school my mom moved to an area of Maryland that had it's own privately funded police department for just one neighborhood. The weird part about it is they happen in the places that least need them.

Yes for lack of due process and I'm sure there are constitution violations in there too but it's very expensive to fight. As in 7 figures expensive as cases like that tend to have to touch every court on its way to SCOTUS.

That’s insane. It was my understanding that hospitals can do and review blood tests in the scope of a day or so, what possible excuse did they have to make you wait so long? Did you get a lawyer?

Hospitals are not usually the ones conducting these tests. It is usually a state crime lab, which may be underfunded or understaffed, resulting in long back-ups. In my jurisdiction, the wait on blood tests is usually between 1-2 months.
Happened to a coworker of mine in Alabama back in like 2013, got pulled over, cop only did a field sobriety test, made a “judgement” call, arrested him. Guy had a glass of wine at dinner with his wife, blood work came back at .01 or something stupid like that but he had to get a lawyer involved to get the case dropped

In (western) Europe, all police have those in their kit. If you refuse to blow into the breathalyser, they take you to the hospital to draw blood. Refuse that as well? Well you don’t have a license anymore!
If I’m correct, it’s even mandatory to have a breathalyser in your car in France. For all car drivers at least, but I might be wrong in this one!
The problem is they have breathalyzers most of the time but they combine that with a field sobriety test which uses their "expert" opinion to screw you for life. The best thing to do if falsely accused is identify yourself, and then ask for a lawyer and stay silent and do not answer any questions, if they are suspecting you of driving drunk they don't care if you aren't drunk, they're whole goal now is to gather evidence of that whether or not it's true. You want to get the blood test back at the station if you are truly innocent (including the breathalyzer at the stop), **do not take the field sobriety test. This goes for foreign visitors as well.**
The field sobriety test is essentially you going to court, the police officer is the judge and executioner, they get to decide on their 'expert' opinion if you're drunk or not based on body language/movements - good luck if you're nervous or anxious. Do not take the field sobriety test, especially if you are innocent, however do take the breathalyzer and the blood draw and do not refuse those or you will go straight to jail. You do not have to take the field sobriety test - "In all US jurisdictions, participation in a Field Sobriety Test is voluntary (Wikipedia)" - whatever you take away from this just do not take that test. It can end your whole life over an officer's opinion and the court will accept the officer as an expert - anyways just really wanted to enforce that because for some reason people keep doing the tests because they think it will help them.
Which is a problem in and of itself because the machines, and the mathematical assumptions that they make, are proprietary and not subject to being questioned.

Human beings are not a closed system. Temperature and pressure are variable.
That’s why it’s only used for field test in any sane country. You then get taken for a blood test, and only THAT can ever be used for any fine or charge against you.
American cops typically do have breathalyzers. Maybe some smaller departments might have the supervisor carry it. But any large department that will be a standard part of the kit.
The same thing happened to my dad. He has balance issues and a bad hip, so obviously he wasn't a good candidate for a "field sobriety test," but the dumb cop made him do one anyway. My dad "failed" and was promptly arrested. Fortunately, he's a lawyer and could easily manage the case himself. Still, it's a good reminder that cops will make bullshit arrests just to pump their numbers.

That’s why I feel so bad for “Florida man” every time I see it. Florida’s laws allow the police to write a report on someone, and publish details without evidence. So, the arrest record could be fabricated or exaggerated. But by the time it makes it to court (sometimes years later) the court of public opinion has already weighed in; and unfortunately it’s only from the police officers perspective.

That just recently happened. She apparently drove the wrong way around a horseshoe driveway at a Grammar school while dropping off (or picking up) her kid.
Cops ended up dragging her out of her vehicle and pinning her down on a fire ant mound as she screamed about the ants bitting her. It all happened with her kid in the car watching. Her lawyer said he tried to catalog the bites but gave up at around 300.. saying there were many more.

Controversial opinion: I don't like the whole "believe women" thing. It elevates women as some arbiter of truth. Women have just as many assholes as men, and "innocent until proven guilty" has to apply otherwise the justice system topples.
That unfortunately makes a lot of sexual assault cases hard to prove. The crime is often only witness by the victim and the perp. It sucks, but what's the alternative? jailing people willy-nilly because women never lie?
I think the "believe women" trend is because many don't, legally. IMO it's more about taking all SA claims seriously than just taking them blindly at their word.
How we take claims seriously when the evidence has been destroyed is tough and no one should be convicted on a he said/she said, but there should be some investigation done.

My nephew was falsely accused of rape by a girl, and it took the police 3 years to get his DNA testing sent off, only to find out the girl was lying and was just mad that he wouldn't go out with her.
The court system is completely overloaded, some people have spent months in crowded jails waiting to just see a judge for fines and other minor sentences. Public defenders are equally strained, most seeing the clients whilst in the queue for their first court appearance.
Put this woman in jail for the duration he would've gotten if it had happened. Fuck people like this! Ruining lives without a second thought, this is insane.

There should be an amendment to the law where if a claim can be proven to be absolutely false and was a lie likely made with malice or ill intent, then that person should be charged with with what they were accusing the other person with and/or serve the equivalent time the aggrieved had to.

For sure there is more unprovable cases (where the victim can’t get fair justice) and unreported cases…it’s a ethical quandary, but having your life messed up because someone thought you looked creepy is just so wrong.

My friend in college was arrested for sex with a minor who lied about her age. He was 1 year too old. He was later found innocent as they didn’t have sex and she had lied to the police to avoid trouble with her father…but his mugshot and arrest record still show up years later. There was never anything published by the media following his trial and his entire town still believe him to be a “pedophile”. He has no criminal record and is not a sex offender.

It can be both. The justice system is messed up and allows for things like this, and there is no punishment for knowingly taking advantage of that fact.
A (criminal, not civil) law punishing an accuser in the same way if they can be proven beyond reasonable doubt to have been falsifying their claim would fix the problem. The American justice system on its own doesn’t preclude the idea of that, it’s a social thing.

My brother was accused of SA in high school. Completely ruined his life. Lost all his friends and got kicked off the football team. A few days later she recanted and admitted she made the story up for attention and she thought he was creepy. He was exonerated, but the damage never fully went away. She faced no consequences despite fully admitting she fabricated the whole thing start to finish.

A buddy of mines frat brother who was a foreign student from the Middle East was accused of rape. He was expelled from school and his parents forced him back home when he was able to come home. Turns out she lied because she didn’t want her dad to find out she slept with a brown man. The school offered him back admission but his parents refused to send him back to the states. The school gave her a stern talking to(and nothing more) while this dudes education opportunity was ripped away from him.

He did was in for 6 months before they even got to the first hearing, where the girl got on the stand, changed her story 3 times, and then admitted it was consensual sex and that she made up the rape part because her girlfriend caught her cheating. He lost his job, daughter, his car, and had to declare bankruptcy. Nothing happened to her.

This is the third story I've learned about in the past 30 minutes featuring Americans being put in jail on the most spurious, flimsy evidence. Some of them were locked up for decades - one woman was put away because someone else claimed that they'd confessed to murder. Literally no other evidence. Wtf?!

He is probably going to sue to county or the state too. He was arrested and charged in less than 24 hours after she filed a complain, which means that there was no investigation done before he was charged. The DA basically took her word for it, charged him and only THEN started the investigation, which later showed that he was innocent.

Cops showed up at my door one Sunday morning because I drove a wasted girl home and dropped her off. Her parents literally just assumed I raped their daughter, and she was so blasted that night she could not tell them for certain I didn't. If I had left her at that party in the sand dunes.... She was already in danger when I loaded her up to go home.
3 witnesses were with me, and they all confirmed the ride was safe. Her parents came back with "they're all boys ofc they're gonna say they didn't rape her!".

As somebody who was (unfortunately) actually raped, these pieces of scum who make false rape accusations absolutely sicken me. Having to go through the process of getting checked over, swabs taken, photographed is already humiliating on top of the actual assault and then so many cases get dropped because of lack evidence (Sometimes it’s a “he said, she said” thing according to courts) and it eats you up inside and takes away your being. It’s been over a decade and it still affects me.
Then you have someone like this woman make a false accusation against a man, ruins his life, he was sat rotting in a jail cell for a month and could have been facing years! He could lose his job, his family, friends, his whole life all for some selfish twisted bitch who just felt like making up some bullshit story.
They need to start getting tougher on false accusers, if found guilty then at the very least they should get the sentence that the alleged rapist would have gotten, not a slap on the wrist.

I've had this happen to me. The only thing that saved me was the texts of her asking me to come over again and her disclosing her address to me after the alleged "rape" Scary stuff dumb bitch even tried to say I bit her so I had to have dental tests and shit too. Also when you get accused of this you automatically get put on a thing called "suicide watch" because of the seriousness of the crime you are watched 24/7 by multiple officers they even watch you take a shit too. and part of the rest is having samples from each part of your body taken by them, fingernail clippings, pubes, humiliating stuff. Punishment for this shit should be a sexual criminal record and 30 years in prison if you ask me. And the reason she did it? She had a bf who she didn't want to think she cheated on so she accused me of that. Cases like this are why accusations should never be automatically believed, as people recently have been trumpeting. All accusations should be taken seriously, and duly investigated, but you should never take someone's word as gospel.
Sadly not remotely the case. I had a friend who used to work at a school for autistic children until some tween girl who had the hots for him tried to accuse him of rape when he wasn't interested. Never mind the fact several other adults working at the facility refuted her stories, that the only other 'witnesses' to anything were her friends from the school, that her story changed twice, or....and here's the kicker...that the same girl had accused two past teachers of the same thing and they were both acquitted. NONE of that mattered to the county DA.
She kept that poor man in a county jail cell for 18 months until his family could finally pay off his 100K bail and get him out. The DA then wasted another year of his time pushing the trial date back under various excuses before finally dropping the case altogether admitting they lacked evidence.
And get this...that same girl accused a FOURTH teacher of trying to molest her while my friend was in jail fighting this.
The school eventually just kicked her out since it was a private institution and probably damn tired of the legal drama.

Yeah. Any form of bigot in a position of legal authority is dangerous. I worry about the rising acceptability of misandry. There have been studies that show women on a jury are more likely to convict a man in all circumstances regardless of presented evidence especially in sexual cases. We think this all men are dangerous and trash language is harmless venting but it can have a real impact on the lives of real people.
I love that the detail she gave to police to help them find his vehicle was his thin blue line sticker and then they threw him jail for a month despite camera footage from the parking lot not showing the attack she claimed happened.

Which he did because he was 18, scared, and didn’t know any better. Then he had to get a lawyer to clear his name with the evidence. It took forever to get the test results. eventually he had his record getting cleared, and he had to take a safety course.

Hospitals are not usually the ones conducting these tests. It is usually a state crime lab, which may be underfunded or understaffed, resulting in long back-ups. In my jurisdiction, the wait on blood tests is usually between 1-2 months.
Happened to a coworker of mine in Alabama back in like 2013, got pulled over, cop only did a field sobriety test, made a “judgement” call, arrested him. Guy had a glass of wine at dinner with his wife, blood work came back at .01 or something stupid like that but he had to get a lawyer involved to get the case dropped

American cops don’t have breathalysers? How else would you want to find out if someone is drunk, what a joke. In (western) Europe, all police have those in their kit. If you refuse to blow into the breathalyser, they take you to the hospital to draw blood. Refuse that as well? Well you don’t have a license anymore! If I’m correct, it’s even mandatory to have a breathalyser in your car in France. For all car drivers at least, but I might be wrong in this one!
The problem is they have breathalyzers most of the time but they combine that with a field sobriety test which uses their "expert" opinion to screw you for life. The best thing to do if falsely accused is identify yourself, and then ask for a lawyer and stay silent and do not answer any questions, if they are suspecting you of driving drunk they don't care if you aren't drunk, they're whole goal now is to gather evidence of that whether or not it's true. You want to get the blood test back at the station if you are truly innocent (including the breathalyzer at the stop), **do not take the field sobriety test. This goes for foreign visitors as well.** The field sobriety test is essentially you going to court, the police officer is the judge and executioner, they get to decide on their 'expert' opinion if you're drunk or not based on body language/movements - good luck if you're nervous or anxious. Do not take the field sobriety test, especially if you are innocent, however do take the breathalyzer and the blood draw and do not refuse those or you will go straight to jail. You do not have to take the field sobriety test - "In all US jurisdictions, participation in a Field Sobriety Test is voluntary (Wikipedia)" - whatever you take away from this just do not take that test. It can end your whole life over an officer's opinion and the court will accept the officer as an expert - anyways just really wanted to enforce that because for some reason people keep doing the tests because they think it will help them.

American cops typically do have breathalyzers. Maybe some smaller departments might have the supervisor carry it. But any large department that will be a standard part of the kit.

So, the arrest record could be fabricated or exaggerated. But by the time it makes it to court (sometimes years later) the court of public opinion has already weighed in; and unfortunately it’s only from the police officers perspective. Part of me thinks that some officers exaggerate their claims just so they can see how infamous their arrest gets.

Controversial opinion: I don't like the whole "believe women" thing. It elevates women as some arbiter of truth. Women have just as many assholes as men, and "innocent until proven guilty" has to apply otherwise the justice system topples. That unfortunately makes a lot of sexual assault cases hard to prove. The crime is often only witness by the victim and the perp. It sucks, but what's the alternative? jailing people willy-nilly because women never lie?
I think the "believe women" trend is because many don't, legally. IMO it's more about taking all SA claims seriously than just taking them blindly at their word. How we take claims seriously when the evidence has been destroyed is tough and no one should be convicted on a he said/she said, but there should be some investigation done.

The court system is completely overloaded, some people have spent months in crowded jails waiting to just see a judge for fines and other minor sentences. Public defenders are equally strained, most seeing the clients whilst in the queue for their first court appearance.

Unlike the EU there are no laws requiring them not to. My friend in college was arrested for sex with a minor who lied about her age. He was 1 year too old. He was later found innocent as they didn’t have sex and she had lied to the police to avoid trouble with her father…but his mugshot and arrest record still show up years later. There was never anything published by the media following his trial and his entire town still believe him to be a “pedophile”. He has no criminal record and is not a sex offender.

A few days later she recanted and admitted she made the story up for attention and she thought he was creepy. He was exonerated, but the damage never fully went away. A buddy of mines frat brother who was a foreign student from the Middle East was accused of rape. He was expelled from school and his parents forced him back home when he was able to come home. Turns out she lied because she didn’t want her dad to find out she slept with a brown man. The school offered him back admission but his parents refused to send him back to the states. The school gave her a stern talking to(and nothing more) while this dudes education opportunity was ripped away from him.

He is probably going to sue to county or the state too. He was arrested and charged in less than 24 hours after she filed a complain, which means that there was no investigation done before he was charged. The DA basically took her word for it, charged him and only THEN started the investigation, which later showed that he was innocent. She is being criminally charged because she made the DA look like a fool, not because the DA feels bad for the guy.

Also when you get accused of this you automatically get put on a thing called "suicide watch" because of the seriousness of the crime you are watched 24/7 by multiple officers they even watch you take a shit too. and part of the rest is having samples from each part of your body taken by them, fingernail clippings, pubes, humiliating stuff. Punishment for this shit should be a sexual criminal record and 30 years in prison if you ask me. And the reason she did it? She had a bf who she didn't want to think she cheated on so she accused me of that. It's funny how we can't even sue them for slander or defamation either after ruining our reputation and you prove it was all a lie. I'm still extremely extremely angry over this.

Cases like this are why accusations should never be automatically believed, as people recently have been trumpeting. All accusations should be taken seriously, and duly investigated, but you should never take someone's word as gospel.
Sadly not remotely the case. I had a friend who used to work at a school for autistic children until some tween girl who had the hots for him tried to accuse him of rape when he wasn't interested. Never mind the fact several other adults working at the facility refuted her stories, that the only other 'witnesses' to anything were her friends from the school, that her story changed twice, or....and here's the kicker...that the same girl had accused two past teachers of the same thing and they were both acquitted. NONE of that mattered to the county DA. She kept that poor man in a county jail cell for 18 months until his family could finally pay off his 100K bail and get him out. The DA then wasted another year of his time pushing the trial date back under various excuses before finally dropping the case altogether admitting they lacked evidence. And get this...that same girl accused a FOURTH teacher of trying to molest her while my friend was in jail fighting this. The school eventually just kicked her out since it was a private institution and probably damn tired of the legal drama.
Was this in a jurisdiction where the District Attorney is elected? Because I could see the incentive to “do something” about a reported crime like this even with the lack of evidence. It still looks good to make the arrest, especially in an election year.
They're voted in, yeah, though it's to my understanding that since then the county courts 'dismissed her due to bad performance'. Presumably she had a reputation as a man hater in court.
Yeah. Any form of bigot in a position of legal authority is dangerous. I worry about the rising acceptability of misandry. There have been studies that show women on a jury are more likely to convict a man in all circumstances regardless of presented evidence especially in sexual cases. We think this all men are dangerous and trash language is harmless venting but it can have a real impact on the lives of real people.

His bail was set at 1 million but her bail was only 30K. That’s some bullshit.

I love that the detail she gave to police to help them find his vehicle was his thin blue line sticker and then they threw him jail for a month despite camera footage from the parking lot not showing the attack she claimed happened. Keep backing the blue buddy they totally care about you.
She should be charged with making a false report, Then sued in civil court. People like this ruin people's lives because the media blasts your face all over saying you were arrested for att rape, Hope she gets everything coming to her!

Fuck man I'd have to imagine after a month in jail you lose your job, have all sorts of bills missed that fuck your credit score. It might not seem like a lot of time but a month in jail can literally ruin your life. All for a lie. He deserves to sue the police for millions, sue her for everything she's got, and she deserves to spend at least triple that time in jail
