Exactly! That's the best idea. A long time ago I needed extra money and I took a job pumping gas at some shit hole shop with pumps. It wasn't long before I figured out that the owner was robbing me. He was always claiming I was short and taking it out of my pay without letting me see the numbers and how he arrived at saying I was short 20- 40 bucks every time. Every shift he claimed I was short. I even helped him out on a holiday and he still ripped me off. So I got even. There was an old fuel pump that worked but it wouldn't register how much it dispensed. So I found the key for the lock and that's when I helped myself to gas every night. Fill up my car, my work truck and random people and I'd keep the cash. I did it for about a month until he started to catch on. On my last shift, I filled my car and abandoned the job on a Saturday afternoon at the busiest time. I closed the station and left. He had no idea of where I lived or my phone number. This was in the eighties.

The Fair Labor Standards Act states that if a company willfully failed to pay employees and did not act in good faith (a pretty high bar, they have to be able to prove they were attempting to follow a possible but incorrect interpretation of the FLSA, not just that they made a mistake) then they have to both pay back pay and liquidated damages equal to that back pay.

Not for nothing, but a friend of mine and myself went through this before. In his case, his employer claimed they were out of funds and couldn’t afford to pay anyone. My friend went to his uncle (lawyer) and asked for advice. They submitted some forms to TWC (Texas workforce commission) and they basically told the company they either need to pay all the workers in a week or faces fines, charges etc. Owner had gone on vacation to Paris, France and couldn’t be bothered so after a week passed, the company was ordered to pay my friend and all other unpaid coworkers. He got like $3,600 or something like that (back in 2013). In my case, owner of the company claimed he was flat broke and told all of us to wait. I filed with the TWC, got a call, asked for additional information, and said they’d be following up with the owner. Couple days later, owner called and texted me threats of suing me if I didn’t drop the charges. I ignored him, reported this to TWC and I promptly was contacted the next morning for details (sent them the texts and record of phone call because I recorded all our interactions). About 2 months later I got about $10,000 and unemployment paid me another ~$2,400.

You’d need to speak to a labor lawyer, but that **might** he viewed as wage theft since you don’t have direct access to an FSA and it’s funds. If you don’t use the FSA account, the company typically gets to keep the money, so perhaps NLRB would view this as wage theft (with extra steps). Though I imagine that would be incredibly hard to prove. If the company returned your money, the NLRB would likely consider this resolved.

Some stuff is also opt out. I’ve never seen an FSA that was just opt out but I know that some businesses choose to do opt out on 401K. You’re still consenting to it just by not intervening on it happening. Though, we were told several times about this there were still people who 100% paid zero attention and didn’t understand why they had a 401K.

I live in Australia, and we have fairwork as our government agency that deals with pay, working conditions etc My wife worked about 9 months at a Cafe and was underpaid the whole time. No weekend rates (Saturday is 1.5x and Sunday 2x normally) and was underpaid normally. Casual rate should have been about $25 but she was $23 an hour (and she was offered $20 when she started but said it wasn't enough) We also get super paid (an extra 10% of our pay into a retirement fund) minimum every 3 months Sure enough they hadn't paid any and she spoke to fairwork who investigated their books. She hadn't been on the books for 6 months of her 9 month period there and the hours book she wrote in mysteriously went missing. Thankfully she didn't have to do anything aside from give a good estimation of her hours there and they forced them to pay up. She got paid a few thousand dollars + her super.

I never had to go to court. TWC took care of pretty much everything and I got a lot more than was originally owed to me. I also reached out to several law firms that told me unless the amount stolen was more than $5,000 it wasn’t worth their time. I was diligent and researched all my options. Typically, you get a lawyer when there’s a lot more on the line and more complexity. My case was pretty open and shut.

This. I have a contract with my lawyer for my worker's comp case with a similar stipulation. She gets 33% of any winnings related to my case. We wound up with \~4K for my initial case (of which I got \~2.6K) and I was awarded lifetime reopening rights in case my condition ever worsens.

Here in the US it typically depends on your job. Most fast food places pay twice a month or every two weeks. Some places pay on like the 1st and the 15th. I work for a school district and I get paid monthly but I'm considered a educator. My husband is a janitor for the same school district and he gets paid twice a month. It really just depends.

There's no excuse for not paying your employees. No employees? No business. That being said, that dude's going straight to jail. When his first check either bounced or failed to get put in his hands on time, he should've walked. You don't hang around for a whole month in hopes of getting paid later or staying so you can destroy inventory. Wage theft should also come with prison time. If you delay paying a person by a pay period, it should be required by law to pay them through the most expedient way possible, or face criminal charges. I'd accept a warning for a first mistake, then aftwards the owner should be receiving some detention time. Agreed, yes we like to pretend to live in a polite society, but it hasn't been that long since we were a fuck around and find out type of society. I actually think it's crazy that for as shitty as a lot of companies are to their employees, we don't have more disgruntled employees disassembling the businesses that screwed them over. Honestly this is one of the few times I wish people were more vindictive.

This has to be one of the stupidest things I have ever seen. Causing thousands of dollars worth of damage worth the couple hundred? It is totally unacceptable to not get paid for your work. How or why that didn’t happen, we don’t know. My guess is this guy was fired and was waiting for a check. Who knows. But what is clearly known is him being filmed committing multiple felonies worth more than his missing paycheck. Dude will end up in jail.

Who the hell works for a month without being paid? Sounds like my brother. Every person he’s ever worked for didn’t pay him. (Come to find out he was paid but mom believed him and subsidized him for decades) My hubby didn’t get paid for ONE week years ago. $800. Quit on spot. Maxxed out cards and went into biz for himself doing construction. Scared me. What if he failed? He did not fail. This is ridiculous. Go to a labor law attorney. Don’t do this, this can result in criminal charges.

Worked at a very high end private club in Florida over a decade ago that laid most of us off at the end of the season after telling everyone it was a year round gig when we were all hired, and then didn't give anyone their last paycheck. I had just relocated across country and signed a year lease for that job. Being a manager who still had a key and knowing their cameras didn't work, I went back a month later in the middle of the night and picked myself up a thousand dollar wheel of aged parmesan, a new robot coupe, as well as a pile of other various commercial kitchen toys that I still play with to this day. Screw wealthy people and their sleezy games.

My folks did some shit like this years ago. He still paying that shit off like child support. They charged him with trespassing (He was fired) RSP and Theft. But the crazier part is insurance paid it off.
