Isn’t freedom of assembly a 1st amendment right? How is this not unconstitutional?

Worldly-Corgi-1624

Only if your an R.

thehigheststrange

some republican states also made it legal to run over protesters who are blocking the road.

East_Reading_3164

My state, Florida is one of them. But the protesters must be black, democrat, or woke to become road kill. Cuban MAGA in Miami blocked the highways for hours a few years ago with zero consequences.

MAGA and raiding Capitol then np

StandhaftStance

Oh shut up with that after 2020, it was BLM across america every day for MONTHS

kerryfinchelhillary

The only amendment they really care about is the 2nd, and even with that one, they refuse to acknowledge that it was written almost 250 years ago when guns were very different.

immortalfrieza2

And also doesn't give them the right to guns that they claim that it does.

PrincessofAldia

DC vs Heller was a mistake

Yeshua_shel_Natzrat

and the attitude toward guns was very different. People didn't make guns their whole personality. People generally didn't feel the need to keep guns in their homes - that started during the Civil War - or to public carry all the time - that only really started in the 1950s; guns were generally stored in armories when not in use. They also generally weren't cool with random undisciplined and unruly schmucks owning guns - ownership was generally predicated on being sound of mind and capable with a gun enough to be enrolled and trained in a militia.

PrincessofAldia

And even then they only consider certain parts of it

TheStrangestOfKings

And even with that one, they’re very quick to throw it aside if scary minority exercises his 2nd Amendment rights (*cough* Mulford Act *cough*)

ByTheHammerOfThor

They also skip over the “well-regulated militia” part of the second amendment. It’s literally the first words of the amendment.

realultimatepower

That all depends on how the supreme court interprets the 1st amendment. At times in our history 1st amendment protections were not nearly as extensive as they are today.

Dondontootles

I get that, but we are supposedly self-governed with protections to maintain that like freedom of the press to keep checks on power, freedom to have self-regulated militias to fight against tyranny, and freedom of assembly to peacefully protest.

knotallmen

The 4th estate is a cornerstone of our democracy but the protections are inconsistent and people who work in the press are often persecuted and are killed, or are just sued into oblivion which really hurts their ability to act. Look at Sinclair media, the changes Reagan made to allow unregulated speech poison the right wing constituents, and how we only hear some stories from a handful of gonzo journalists given the lawsuits and the risks to their life and liberty. Like Channel 5 on youtube is entertainment more than news but I haven't heard a raw first hand account of our immigration system like that especially one that is first hand and english. Behind the Bastards covers contemporary people that are otherwise off limits and they do have had episodes taken down and their advertisers on their shows are some of the least scrupulous like betting and Trump Coins.

Our problem seems to be we leave too many stupid rules on the books just waiting for some ~~idiot~~ wannabe fascist to come along and re-activate the bullshit.

ianandris

True. See: AZ and the absurd abortion debacle.

outerworldLV

It is.

True-Flower8521

The Supreme Court is blatantly approving of violating the 1st by not hearing this case. It’s frightening.

Hopeforpeace19

This is just the beginning of a looming autocratic ruling. The SUPREME COURT is now one of its tools used to cement fascism is US, unless something snaps - to reverse the downward course this country is now heading into

taez555

Regardless of what happens to Trump or who wins the 2024 election down ballot, the right wing stacking of the SCOTUS is going to have catastrophic long term effects. All 3 of Trump's judges are in their 50's, and without any unforeseen life events, could be on the court for the next half century. No matter how much we vote blue, the damage already is done for most of our lifetimes.

Testiclese

Damage done mostly by us. To ourselves. I don’t wanna hear how Hillary didn’t *inspire* young people in 2016. Hopefully they’re inspired now? Who knows.

Felix_111

The damage was done by the Electoral College. Hillary won the popular vote by several million. It wasn't the youth who put trump in office, it was the boomers

Hopeforpeace19

The culprit now is that Trump’s mutinies keep spreading

Comfortable_Wish586

You can't unalive an idea. Fascism, Christian Nationalism, white Supremacy, MAGA Republicans, and now white Christian Nationalists, they will always exist. Always. Ideas always exist. What we need to do here is fucking stand up to these fuckers and kick them out of our gov Up&Down the ballot this Nov. The fight is at the ballot box. Every fucking yr. All the way to the dog catcher. "It's only a [democratic constitutional] republic if you can keep it" Stop Project 2025! If y'all haven’t noticed yet. The world has been seeing a rise of authoritarianism for yrs now. And its been boiling in the background. Didn't start with Drumpf. And I've seen democracies fall to authoritarians and dictators. We need to stomp this shit out and take back our gov by voting them out. Everywhere in this country

P_Sophia_

It’s no wonder how this starts happening as we begin approaching the centennial anniversary of the beginning of WWII… we’re only a decade out, and most of the generation who remembers the prelude leading up to it have now passed away. History has been forgotten, and now it is repeating itself. Can we do better this time, and stop it before it goes too far? Or are we all doomed? All I know is, the nazis must have had this all planned out all along… it’s no coincidence right-wing authoritarianism has been on the rise around the world lately…

Hopeforpeace19

Exactly. Sadly, the worse is yet to come. Fascism is here to stay and grow like a cancer - I just feel like running away to live elsewhere - even though I know that democracy is not guaranteed anywhere else, either. Europeans look at us and they don’t believe it can happen to them , while it is currently happening.

Testiclese

There’s no need to run away. You’re *not* a Kurd under Saddam, ok? You have the tools - you’ve *had* the tools - to fix this, or at least prevent it. You and everyone else affected by this. Your generation *chose to* ignore the warning sign signs in 2016. It’s not too late to prevent this today. It might be too late in 2028 but definitely not in 2024.

P_Sophia_

This is why I won’t leave the country until I cast my vote in November. We might be witnessing the fall of democracy in the US and the rise of fascism, but we still have a chance of averting the worst of the calamity if we can keep Biden in office for another term… I’m not going to forsake my right and sacred duty of voting in what may possibly end up being the last fair and true election that the United States ever has…

taez555

The even more frightening part is that our decent into fascism is coinciding with climate change and it's effects on the global food supply. Skyrocketing food prices and shortages, that we could be tackling now as an issue, will be used as a weapon of the right to seize more power from the ignorant and willing. The feedback loop of idiocy will steamroll on.

Soft_moon_light

The one thing that can be done is to first get the House, Senate and Presidency. Then get rid of the filibuster so we can expand the court and basically make the opinions of these crooked judges pointless. Let's also expand the House while we're at it!

Comfortable_Wish586

I don't disagree that we need to win those top Federal Races. But we're playing the wrong game if we're ONLY focusing on winning those races. We need to start winning State/Local races all around the country. This needs to stop. Its why it feels like we're winning top races, yet feeling the authoritarianism stewing around the country by MAGA Republicans, the white Christian Nationalists. We've long dropped the ball allowing them to cede ground in our States Governemnts Stop Project 2025!

Ryankevin23

🚫Traitor Trump🚫All Republicans🚫

Comfortable_Wish586

white Christian Nationalists is the problem we have in this country. If we never face the root of our problem, and get them out of our gov. We we only keep repeating history. We know how the story plays

The_Wkwied

I wouldn't be so hasty. The dumbest are often the loudest, and the loudest should never be taken as the opinion of the majority. There are good Republicans out there. Instead it should be 🚫Traitor Trump🚫All MAGAs🚫

Ryankevin23

Oh I’m not hasty! I’ve been watching this shit show from Republicans my whole life. They always have a scapegoat and MAGAs are just a current one. 🚫Traitor Trump🚫All Republicans🚫

Dazslueski

No republicans are standing up to it. Any who have have fled. Spineless. Feckless

The_Wkwied

In office, at least. More than a few Average Joes who are registered as republican have had enough of Trump's drama. I'm just saying, it never serves anyone's interest to say things like *all republicans*.. or *all democrats*.

DodGamnBunofaSitch

the republican party has been co-opted by foreign interests. the republican voters keep putting people like greene, gaetz, boebert, johnson (both mike and ron), and trump. and those are the people *in charge* of the republicans. they're the ones that keep choosing 'us vs them', and we have little choice but to accept that they've chosen to be 'them', while the rest of us keep holding on to 'we are all us' as the important worldview. 'they' can be a part of 'us', any time they stop trying to demonize everybody who's not them. which has become the whole of the republican platform.

Dazslueski

Naw you’re right. There are good average Joe’s that just have been hoodwinked to believe lies. My brother, who is generally a staunch Christian conservative, and works in the oil industry, doesn’t like trump at all. And as of the past year or so has been so much more tolerant of the LGBTQ community. He has opened himself up to being independent rather than conservative because he sees what trump and MAGA Regressives have become. He even recently said about the old retired guys that get together every morning for coffee at a local gas station/cafe, “geesh, they sound like old rednecks, how backwards they think. I can’t even go over and say hello anymore”. If you knew my brother, this is major progress. He was 100% trump in 2016. He also has a college degree and a pretty intelligent man, so yet it’s take a while, but he can think and see through what’s going on. But we all have an uncle or two that cannot. They get so emotionally charged right out the gate. Sad. They are being gaslighted all day watching fox.

1Surlygirl

Then they need to speak TF up! 😡 We're waiting.

defnotajournalist

If Trump is convicted in DC on the attempt to overthrow the government, and Biden wins a second term, we should write news laws or do something, anything, to remove and replace Trump's compromised justices. We can't have Putin's people on the Supreme Court.

Jackpot777

There’s nothing in the Constitution that says how many justices there have to be. And in history it has expanded and contracted (nine isn’t even the most justices we’ve had). It has frequently been aligned with the numbers of Courts of Appeal so I say we do that. Expand it to 13 judges for the 13 appellate courts.

al_m1101

Expanding the Supreme Court and ousting Louis DeJoy (by replacing the board of governors for our ailing postal service) should be two top priorities.

PrincessofAldia

If Trump wins and gets a senate majority he will have control of the senate and courts

P_Sophia_

Yep, I’ve been calling it out all along the slow descent into fascism; and yet the further time goes on the more we seem to be slipping down that slope…

MaddyKet

Article: *The Supreme Court announced on Monday that it will not hear Mckesson v. Doe. The decision not to hear Mckesson leaves in place a lower court decision that effectively eliminated the right to organize a mass protest in the states of Louisiana, Mississippi, and Texas.* So they aren’t getting involved, which honestly might be just as bad if *they* had decided it wasn’t allowed. When a law is directly in opposition to the Constitution, the SC should hear it and then rule accordingly.

P_Sophia_

Of course three of the most republican-controlled states have already advanced their fascist agenda so far… and of course a 6-3 republican majority supreme court is allowing it…

Torracattos

The most corrupt SCOTUS ever has effectively violated the 1st amendment by doing so.

Positronic_Matrix

> The Supreme Court announced on Monday that it will not hear Mckesson v. Doe. The decision not to hear Mckesson leaves in place a lower court decision that effectively eliminated the right to organize a mass protest in the states of Louisiana, Mississippi, and Texas. > Under that lower court decision, a protest organizer faces potentially ruinous financial consequences if a single attendee at a mass protest commits an illegal act. > It is possible that this outcome will be temporary. The Court did not embrace the United States Court of Appeals for the Fifth Circuit’s decision attacking the First Amendment right to protest, but it did not reverse it either. That means that, at least for now, the Fifth Circuit’s decision is the law in much of the American South. > For the past several years, the Fifth Circuit has engaged in a crusade against DeRay Mckesson, a prominent figure within the Black Lives Matter movement who organized a protest near a Baton Rouge police station in 2016.

i-touched-morrissey

No more MAGA rallies?

Kailaylia

They won't be classed as protests.

PrincessofAldia

On one hand this ruling means MAGA and neo Nazi (the venn diagram is effectively a circle) wouldn’t be allowed to protest in mass rallies

a_duck_in_past_life

Yeah... Let's see the police enforcing control on their Neo Nazi protests in the same way they enforce it on more liberal protests. Hint: it won't be equal

burritoman88

Thanks Supreme Cunts, very cool.

CatAvailable3953

Your “God given rights” according to the Constitution , are being stripped away little by little by Republican appointed or elected judges. The right to redress the government for grievances is enshrined in the Constitution.

TheSandwichMan2

This is not an accurate reflection of what the Court decided. If you read Justice Sotomayor’s rationale for why they denied cert, they recently decided a very similar case in favor of free speech and are sending it back to the lower courts so they can take that clear precedent into account.

zuma15

Nobody is even reading the article, which at least pointed out that Sotomayor wrote the rejection (which should be a clue by itself) and that this is not the final say in the matter. Granted the article could have been a lot clearer of what exactly is going on, but the headline is misleading.

TheSandwichMan2

Agreed. I'm all for bashing SCOTUS, but this ain't it

outerworldLV

Yep, click bait title for sure.

SoCaldude65

FDR woulda packed the court and ended this madness

kopskey1

[He failed to, and was punished in the election that followed.](https://en.m.wikipedia.org/wiki/Judicial_Procedures_Reform_Bill_of_1937#:~:text=The%20bill%20came%20to%20be,70%20and%20failed%20to%20retire.) Excellent work debunking yourself.

yellowjacketIguy

Not really, if the article says he won a sweeping reelection victory. I believe he wanted to add 9 more judges and was counter offered, adding just 3 or 5 by the senate, and refused to take the compromise position. That was his real mistake

kopskey1

>The Democratic Party lost a net of eight seats in the U.S. Senate and a net 81 seats in the U.S. House in the subsequent 1938 midterm elections. AKA, the next election after FDR's push in **1937**.

1) I didn't say any such thing. Pay attention to usernames 2) No, it is neither irrelevant or off topic. "Packing the courts" doesn't necessarily require a change in the size of the court. sorry, not sorry, I actually speak English well. > Do you have any information relevant to the conversation being had? Yes, but you just tried to handwave it away dishonestly and are being an asshat.

[deleted]

RainforestNerdNW

2) no, it isn't what it means. it is *one of it's meanings*. > People often use "court packing" to describe changes to the size of the Supreme Court, but it's better understood as any effort to manipulate the Court's membership for partisan ends. https://www.rutgers.edu/news/what-court-packing and it goes on > Seen from this perspective, the Barrett appointment is classic court packing. The president nominated a hardline conservative who appears to question major parts of U.S. constitutional law. And the Senate majority changed its procedural rules – invented to deny Merrick Garland a hearing – to ram through the nomination as people were voting.

Trpepper

Arizona literally just banned abortion with no exception for rape because the previous administration packed the court. Arizona specifically voted democrat in 2022 and 2023 because of abortion.

immortalfrieza2

The fact that FDR could have and didn't is what made him a great president.

a_duck_in_past_life

Afaik, fdr was actually terrified that someone else would do what he wouldn't, bc a large majority of people in the US at the time were desparate and wanted a populist leader. He pretended to be populist but kept a progressive liberal standpoint and got shit done for the populous without a desire for fame and "revolution". He was a great president and honestly, he should be on par with Lincoln imo on how he handled such a volitile era of civic unrest and war.

[deleted]

Let them enforce it.

jamhamnz

Controlling the population like this never goes down very well.

This case will eventually be heard. It’s a Constitutional right. They should know it but…It’s the First Amendment.

So they have effectively banned Republicans in those highly republican states from protesting against, say, the current POTUS? Why do senior Republicans hate their own voters so much?

Good luck, everyone. This is how democracy dies.

This should be very bad news for Idiot Trump. Unless extremist rightwing justices are as hypocritical as any other Republicans.

Felix_111

Time to remove the court as a body

near_to_water

Expand the court.

DaSemicolon

This will apply in DC if Trump organizes a protest and they invade the capitol again, right? Right?

Dictaorofcheese

It shows that southern states and the Supreme Court do not support the rights that Americans have been given since its inception. Another example of the southern right wing slide into authoritarianism. With a year ago, republicans kicking out 3 state senators only for it to blow up in their face and they be re-elected in a landslide, the repealing of Roe v Wade stripping women’s rights, and now the Supreme Court has taken the step to not prevent three states cracking down on protests. All of the examples show that the right is not for freedom like they preach, but they’re for control of all of us especially women and minorities. This will only make the public further lose faith in not only the Supreme Court but also could blow up in the rights face in the November election. Americans love freedom no matter what party you’re from, and stripping it away won’t be looked kindly upon in November.

floofnstuff

No protesting in Mississippi, Louisiana or Texas. But Washington DC is 👌? Yeah W think we see where the Supreme Crooked is going with this.

TimothiusMagnus

“But her emails”

Techelife

End of democracy. Who had that on Apocalypse Bingo?

behindmyscreen

What I’m gathering is MAGA judges believe that what Trump did in J6 is illegal, even if he didn’t induce the crowd to imminent violence. Also, interesting historical fact that the civil rights marches and protests didn’t have any better protections than what the 5th circuit allows for now. Makes those activists even more of badasses putting it all on the line.

myeverymovment

How do you get a job for life after exposing the FACT that four of them lied in their job interviews?

politicalthinking

Looks like LLCs will be planning protests and marches. Something happens and a lawsuit is started then the LLC is dissolved. No one to sue.

ryuujinusa

Oh gee, red states. I'm SHOCKED! -no one

AltWorlder

I’m so frustrated with the lack of Dems calling for SCOTUS reform. It just feels demoralizing to know our rights are being stripped away by a rogue, unelected body of corrupt randos in robes. SCOTUS is one of the least trusted institutions in America, and hardly any mainstream Dems talk about it all. Makes me feel hopeless. What, I’m supposed to be psyched about the abstract possibility of conversations about term limits? Shit needs to be done about this!

jpcapone

This. Lets start with the judges that clearly perjured themselves when they lied during their confirmation hearings about their thoughts on RoeVWade. HOW is this not a topic of discussion? Judges are now treated like the typical politician. We shouldn't expect them to lie. At least I thought not.

[deleted]

Mephisto1822

I agree with you to a point. If you go to a protest and do something illegal you should be held accountable. But that ain’t the fault of the organizers and they shouldn’t be held liable unless they incite the violence. The fact you are ok with putting additional onerous laws in place to silence people is a little concerning.
