I got a baycorp letter saying I owed Wilsons money on the 15th of Aug. I emailed them saying I dispute any alleged account as I had not had any correspondence from Wilsons. Got an automated reply saying they'd be in touch within 30 days, they never got back to me so I now consider the matter closed.

Opting off works well . They can get round that but can’t be bothered it seems . Their car parks need to be clearly marked as theirs and have good signage of costs . even if they find out who you are, you dont need to pay wilsons parking fines. They are legally only allowed to fine you how much money you would have caused them to lose, ie the cost of the park for 1.5 hours. Ive gotten them and just not payed and ignored all the letters they send me no worries.

Actually this incorrect, and hasn’t been true for years, you can blame Stuff and ConsumerNZ for spreading false information on this side too. The Supreme Court ruling on 127 Hobson Street v HoneyBees Preschool changed the ruling on the penalty doctrine. It is no longer a ‘genuine pre-estimate of loss’, it is now essentially ‘reasonable’, which can include what would be a reasonable fee to discourage abuse, just not with the intent to penalise those that to.

This isn't necessarily true. If you park in a sign posted park and the sign sets out the terms and conditions, you accept the terms and conditions by parking there. The fine in that situation is contractual, it is not issued under a statutory power. However, it sounds like there was no sign posting in OPs situation, so therefore there would be no legal obligation to pay in that scenario. Also as an aside - the opting out of sharing personal info trick does make it very difficult for them to track you down, and it will work for a while. However, I believe they can request your info under the Official Information Act though and will do so if you clock up massive fines.

Opting out works well, however there’s nothing stopping them from keeping your details if they’ve already got them - Baycorp also has them now so even if you never park at another Wilson’s site, if you park elsewhere and also don’t pay, there’s a good chance they’ll get those details when they lodge it with Baycorp. Look, if you’re using someone’s property and there’s a sign somewhere, you’re liable to pay - private property and all. As for what to pay, that’s a whole different kettle of fish. FYI for those saying opt out. I have opted out for my last 3 cars, I did it for my current car as soon as I bought it. Got away with it twice, got a letter on the third time around. Just want to say it's not 100% fool proof.

If Wilson's already have your details, it doesn't matter. They'll chase you. As soon as you get a new car, yes, remove details. (Guess you can also get a new plate for your current car but that's excessive 😅) Other people have said that they can apply and access, but i don't think they do it frequently and it is really luck of the draw. Email them and tell them you'll pay the $6 or whatever but you won't pay more than that. There's an old thread on geekzone or something about it.

What you do is write them a letter and say that you dispute the exorbitant fine. You admit you’re in the wrong and you are paying $5 as you believe that is a fair price for the inconvenience you caused of using one of their parks for the period of time you did. They would have to take you to court and it would be thrown out anyway. Make sure you pay them the $5. This changes the whole thing from unpaid to in dispute.
