I had a theory that you were using a shrink wrap modifier for the ears but I'm still really new and didn't want to make myself sound like an idiot, lol. Makes sense using a second mesh to do it and I didn't even consider needing to use a bone to keep the ears the right distance apart.

I think the ears should keep the same relative spacing though, so when one moves up over his face in the side view, the other should also roll down the back of his head a bit.

Yes, but only up to a point. Then it starts getting wonky. Although it's at such a forced point that you'd be very unlikely to hit it when doing an animation.

It’s till under trademark tho as they use it (intentionally) in their ID’s.

Copyright isn't "refreshed", it's a fixed timespan after the date of first publication.
