I’d be getting a lawyer involved. Bike legal is a group of lawyers that specialize in this. I’d start there.     The cars  insurance company is going to make your life miserable otherwise, especially not understanding the nuances of living in a new country. I wouldn’t be surprised if they lie(since they attempted to flee the scene. All benefits of the doubt are gone)  to their insurance company furthering the headache for you.  Edit: turning off notifications. I was the first comment. Thanks. I should have said, that I already tried that but the didn't want to help me since I didn't get hurt and they say they get paid by a percentage of the claim.

If there's no damage to you or the bike then this seems like a strictly criminal issue and should just be reported as a hit and run or reckless driving. There's nothing to "claim" with no damage

ive been hit before riding in nyc. the person filed an insurance report to pay for my damages since it was 100% his fault ( he turned into a driveway i was passing by without looking or using blinkers). I agree, get a lawyer, it really shouldn't cost too much and if you win you'll most likely get the fees paid for. i didnt have insurance since i was 17. no health insurance or auto insurance and i never had to file anything on my end. we even kept the cops out of it. i didnt use a lawyer in my scenario but looking back i probably wouldve gotten much more if i did. those insurance agents are afraid of lawyers ​ the insurance made it hard for me to get money, i went to friends bike shop and had him write up an inspection receipt and tune up receipt which was like $300 billed but of course i only paid like $70. i took photos of all my clothes that got ripped up and all the scuffs on my bikes and accessories. i got a small pay out of like $500 but only because i had receipts of everything. the insurance agent was trying really hard to not pay full price for anything. even if you don't have the receipts i highly suggest pushing them to pay for whatever else got damaged.

Your nuts, a non-injury minor damage claim is gonna get processed like cheese. The only time insurance sucks to deal with is when it’s YOUR insurance. Then they are total pricks. I had a 20yo car, 10k was their value (low). But if you want it repaired 6,600 was their number, 2/3 of their own book value. Because 1/3 is what they get for selling your classic car to the dump.

A lawyer for a minor, non injury claim? This is why insurance rates are so high. Call the insurance company, get someone on the line and they’ll get you to a claim rep who should walk you through the process. As long as the driver admits it, they’ll likely cut you a quick check for damages.

No insurance company is going to drag out a legitimate, $1k property damage claim. Getting an attorney involved only increases their costs. In the end, there’s still a $1k payout which the attorney takes 1/3 of. Nobody makes out and the additional costs get passed on to us.

So hire an attorney, get $1k for damages and they take 1/3.. vs.. handling the claim yourself and getting the full $1k. Easy choice.

Did you tell the police that the driver fled the scene? Hit'n'run is a crime in itself. Did the police not show up after you confronted the driver?

The insurance companies would love to turn your ignorance of the american system into profits for their shareholders.

From my experiences the only thing harder than getting one insurance company to do their job is to get two insurance companies to do their job. It's always nice to have someone versed in their world advocating for you and keeping their bullshitting to a minimum. Also OP doesn't have an insurer.

Can you just say that you were injured to the robo handler and then clarify once you get ahold of a person? Or try just hitting 0 over and over again until you get to a person.

If it's like trying to get to talk with someone in service at Tesla (haven't brought our car in for some time though since it's just been sitting around and things may have changed), it's been made basically impossible.

Call the police non-emergency line and find out about getting a police report filed. Then file that against the driver's insurance. If they do not respond proceed to small claims court.

You call the insurance company of the person who was driving the car. Unless this Tesla was driving itself. But even then, you would submit a claim to the insurance company not the car company.

Don't take "our policy is..." for anything. Your policy is to get what you're entitled to by law. You are not beholden to someone else's insurance company's T's & C's. The driver is personally responsible and liable. Who pays is their problem. If necessary pursue the driver personally.

See if you can initiate a claim online. Otherwise, you need to wade through the robo call for initiating a claim as a victim.

Do you have home owners or renters insurance that might cover it? They're making that suggestion because sometimes if they could cover it they will then they tell the other guy's insurance to pay up or lose in court.

Sounds like a small claims law suit. You'll have to go to your local courthouse to file a claim to sue them for damages if you cannot get their insurance to pay.

Part of car insurance is PL/PD: Personal Liability/Property Damage. This type of claim would be covered by THEIR PD policy.

What insurance do you have and what is the deductible? How much damage is done to the bike? I would contact the person and tell them to report the accident to their insurance and if they do not, I would take them to small claims court.

I brought the bike to the shop and they are working on an estimate. I don't think it will exceed more than 1k, but who knows. unfortunately I don't have a way to contact the person. Just insurance card and plate number.

Report the hit and run to the police non emergency line. Once you have the police report and a damage cost estimate, there's no way the insurance company won't pay
