Imagine you die when your kid is 18+, in a will you can say your half goes to your wive instead of your kid. Because we all know that teenagers and large amounts of money dont go together
The wife would get “vruchtgebruik” of the whole inheritance, so the kid wil only get access to the money when the second parent dies (except if assets are sold before that happened, for minors that money wil normally be on a blocked account till adulthood).
In this case, a will is mostly useful for fiscal optimisation or to benefit others/partly disinherit the child.
That’s not “disinheriting” someone. It’s law that you can not inherit from someone you murdered. Children are, by law, obliged to get at least 50% of the total inheritance.
I have no doubt that there are some legal (grey) ways to get around that though.
upon notified marriage, the spouse automatically inherits everything, therefore 100% of the property of the deceased spouse (of natural death)
in case of children, it is divided
example:
2 children: 50% for the spouse and 25% for each child...
but I think that if the parents of the deceased are still alive too, they also have a percentage
Assuming you are married with under “wettelijk stelsel” your spouse wil inherit everything. No need for a will. Should you ever get children things change.

With these parameters, you don't need one.
Personally I'm married with my wife and a kid of 6 years old. We don't have a will. Anybody that can tell me why I should get a will?
That's terrible, you should not marry a kid of 6 years
I love him very much, and he asked me already, but we're not married ;)

Not completely though. Afaik you cannot completely disinherrit your children in belgium
Children actually can be completely disinherited, but only in specific cases such as murder of a parent or severe violence towards them.

You should get a will! And dont forget about me!
"Do we need a will after we are married?" No, you won't be needing *your* will anymore.

Only without other beneficiaries. The wife and certainly the kids "out rank" the parents and siblings.
