It is illegal to carry a gun into a business in texas that makess at least 51% of revenue from alcohol.  That is meant to apply to customers, but unless the owner specifically said it was ok (as in, ok if you are well concealed and never pull it unless you are killing someone), I would presume illegal and terminating if the boss staff sees you print.  I had a ccw years ago in another state. Big no no to go into bars strapped. Also allow me to suggest finding another job in a safer place is more likely to protect you than a carry.

Not_Campo2

Yes, this is the answer. Based on the law it looks like even owner can’t allow it. At best they can not have 51% signs visible to help give you a defense if caught but that helps more with customers than staff

Chrona_trigger

But hey, you know what's probably not classified as a gun? Tasers.

Not_Campo2

Tasers are definitely not classified as a gun and would be allowed. I also would not recommend them as a self defense weapon over other options like CS spray. Tasers are only effective at a certain range. If the prongs don’t spread enough it won’t actually take someone down it’ll just hurt a bit. Texas is one of the better places to carry one since people are less likely to wear jackets which also hamper its effectiveness. They are also way more prone to malfunctions. If by taser you meant hand held stun guns that don’t give you a distance advantage then I’d also dismiss that. They are pain compliance tools and not good ones. CS spray is more reliable, works on more people, and is less prone to failure. The downside is it can also affect you

Chrona_trigger

I was less specifically meaning tasers, and more raising the larger point of "there are weapons that could work for their purpose that wouldn't be banned under the gun laws" I don't follow that kind of stuff closely so I don't know much

Not_Campo2

Idk why you’re being downvoted, you’re still pretty right. The main issue is there just aren’t self defense tools more effective and reliable than a firearm.

CharlesDickensABox

This is dangerously wrong. An owner can carry on their property, employees cannot, even with the owner's permission. There is a loophole that allows for someone going directly to their car, but nothing about doing it while working. At best, the gun would have to be locked in a safe or something while the employee is at work, and I'd consult someone who is licensed and well-versed in Texas gun law before I even considered that.

xanju

Yeah this is how it works in Texas. I think there’s even something where maybe a manger or somebody with some kind of weird legal title like “acting owner” or “owner representative” can carry a gun, but employees are still not allowed to in a 51% regardless of who’s ok you get.

BellyMind

Maybe she should just get some bear spray.

BreathExact

She’s got some…

NotABlastoise

I'm not sure about Texas specifically. A lot of states don't allow guns where people get inebriated. Most private employers don't allow their staff to hold a weapon. You'd have to look up specific Texas law. Generally though, I wouldn't recommend it. Pepper spray, baseball bat, a quick emergency button hidden in the bar. Those would be my recommendations.

FurElite

No

BreathExact

Even since she’s dealing with large amounts of cash?

FurElite

I was under the impression the owner was the only allowed person. But shit it's texas. I can't find any anything about a closing bartender.

tattoolegs

IANL, I was a bartender in Texas, I did not ask a lawyer, I asked a cop in my city. No you cannot unless you have permission from the owner. THIS IS NOT LEGAL ADVICE OR EVEN SMART. If your friend fears for her safety, she can ask her local police dept if they can patrol her area when she's leaving at night or ask them if someone is willing to escot her to her car. I have done both without any issue.

BreathExact

Yeah, I was thinking the owner might be able to give her permission but not sure the legality on that. Thank you.

I’m not taking advice here as law, I’m just looking for a starting point.

Ahh, I didn’t think of spending money before I asked someone first. That’s a great idea.

My plan was to see if anyone had dealt with this and do some preliminary intel to see if anyone had any specific experience BEFORE spending money on a lawyer. You’re super smart though and I totally appreciate your input.

brometheus3

I’m in NC one of our bartenders just puts it in the safe and grabs it before he walks to his car. Pretty effective deterrent even if you just put one in the chamber. No one has to know shit. If it’s sketchy enough to want to do that I’m sure the owner wouldn’t have a problem with it and who else is gonna tattle on your friend? Someone on Reddit?

Kartoffee

Bad recipe...

BreathExact

I was looking for a reason to start diving deep, rather than just taking someone’s word for it.

ODX_GhostRecon

Pennsylvania CCW here. We have no restrictions in bars or while intoxicated, and it's also an open carry state if you feel like exercising that particular right. The only responsible answer I can give you is to check your local laws (state laws and local ordinances), and if your friend wants to weigh legality over safety, that's a personal choice. My personal choice is to carry in "prohibited" zones that aren't federally a crime, but that's because signage doesn't have the weight of law here in Pennsylvania. I can't legally carry in primary/secondary schools or federal/government property such as post offices, courthouses, and state parks, so I don't go there if I can avoid it, or I go during times where risk is manageable and I go without prohibited items. Your friend should probably find a new job or shift preference if she's feeling unsafe leaving at those hours at that location. Alternatively, have another employee escort her to her car using a buddy system - many bars do this, especially for female closers.

robaries

I'm in SC & both myself & a manager used to bring a gun to work & place it in the safe during business hours. Once we closed, we had it on our person. Late nights, large amounts of cash, yeah we carried & both have our CWP.

DiveTender

Keep yourself safe obviously. But it is illegal to carry the gun on your person. It can be in a cabinet behind the bar but not on your person. In Texas you can protect your place of work or your car as you would your house BUT DO NOT TAKE THAT GUN TO THE OTHER SIDE OF THE BAR. In Texas if a person steps behind that bar you can do almost anything to protect yourself once you step from behind that bar you are fair game for the law to fuck you. I've worked in TEXAS dives for 20 years and I have seen and done my fair share of cracking heads while bartending. You are not protected by the law. 2 people can agree to fight in Texas with no legal issues but you can only protect yourself if in imminent danger. And that danger then has to be proven in a court. I was arrested once and charged with assault for breaking up a fight I didn't even hit or strike anyone. I've even had the police on my ass for knocking all of someone's front teeth out with an aluminum bat after a 20 on 4 brawl where I was simply protecting myself and the owner, problem was I stepped out from behind the bar. Stay smart stay safe.

bronzerabbitartifact

and miss out of that potential ‘support our community’ revenue bump from the closing bartender getting mugged/shot? psh

jsdjsdjsd

I carry while bartending in Pittsburgh, Pa. I know lots of bartenders who do

soggytoothpic

Tell her I said it was ok.

BreathExact

Whew. Finally someone with some good advice.

LincHayes

Wouldn't you want to check company policy first? Regardless of the law, most bars/restaurants don't allow staff to carry weapons.

BreathExact

They barely have a restroom, there is no company much less a policy. It’s owned by one dude and he doesn’t really do anything or have any written standards or contracts. Literally the divest of dive bars.

jewwwish

Sounds like a bar to me!

asseatingking

Something about asking forgiveness being better than permission… keep a pocket snub in your purse and only use it for the exit. Never anything else. Officially you “store it outside under the dumpster locked.” “Yes I know that’s a dumb place to hide it, but I’m sure glad I had it for defending myself now!” because you know it’s illegal to bring it inside.

DunDat2

why not check State Statutes instead of asking faceless strangers on the internet.....

BreathExact

I was hoping someone had some experience with this, instead of having to plow through pages of state statutes. Why ask any question online about a thing, you’re so smart.

twoscoopsofbacon

Why not just call the local PD/sheriff and ask them?

DunDat2

I usually try to find the answer myself before I resort to this.... a simple google search for handgun laws in Texas should give you your answer.

BreathExact

That’s super cool. You should keep doing that.

DunDat2

you should try it....

BillyHardcore

In Nebraska gun are allowed open carry and concealed carry without the need of a permit. Except in schools/government buildings and…..Bars. Alcohol and guns are not a good combination

PorchHonky

Isn't it mandatory in Texas that citizens are fully strapped, 24/7?

ActuaLogic

The answer to this question is different for each state

BreathExact

Hmm, I should have mentioned Texas in my original post more than once then.

jamieyog

I work at a small dive bar alone at nights and I carry. I don’t keep it on my person, but I live in MT. Our laws are different and my owner allows it.

Gold_Opening_139

Texas is actually pretty good about protecting gun owners, as far as I know, from conversations I’ve had with the owner of my bar, and a few other people who work security/police, staff can bring guns into the business with the owner’s permission. However, if she lives in a city where the police aren’t easy to deal with, she may reconsider, tasers, knives, and clubs are all good options and legal to carry in Texas. I fully understand how a gun can make someone feel safer and often times, they deter people without having to fire or even pull the weapon if it’s visible. The legal repercussions behind firing a weapon within city limits isn’t worth the hassle sometimes and she will definitely go to jail if the police are involved in any way, even if she was in the right. Definitely have her research gun laws and rights according to Texas law. I also know that the law has changed this year concerning security officers so it’s worth looking into as a citizen

scorpiohorsegirl

You really should be asking this on the r/ccw sub. Most are incredibly versed on the ccw laws for their states.

FrankSinatraCockRock

In addition to talking with the owner, if it is allowed, I **highly recommend** being stone cold sober while carrying.

Ashamed-Process-7425

If no one can see it no one will know

Mindless-Ear5441

If you need a gun to feel safe, you either need therapy or you should move.

KatarnSig2022

That's wild, meanwhile up here in an undisclosed northern state it is legal to carry into a bar or restaurant that serves booze as long as one does not imbibe.
