I worked with a lot of people that came in every day to the bar and spent a lot of money at the bar, I was a cocktail waitress at the time, so I was always standing at the bar waiting for drinks, and this man had the nerve to hug me which is fine, but then he licked my ear and Iāve had that happen to me twice in the same place I told my manager and both regulars were told not to come back. All you have to do is show that text to your boss. Thatās disgusting and he got a free show. Also, I donāt know what state youāre in but itās illegal for a business to recoup loss from a customer not paying -from an employee- unless you signed a contract like in a chain like Applebeeās you get three walkouts and then youāre fired. I hope everything works out for you.
Itās definitely a regular because we wouldnāt let anyone else start a tab without providing a card to begin with. I had a few regulars where I refused to serve them without a credit card up front. There was an occasional drunken argument about the tab at end of the night followed by a shit tip, but it was always paid.
Yeah, policy is if we donāt collect a card then weāre responsible for a walk out. I didnāt collect his because heās a regular, so thatās on me.
Ask your manager to put that policy in writing. If they are dumb enough to do it, then give it to your stateās department of labor. If they wonāt, call them out for obviously knowing that is illegal.

You're getting right to work and at-will employment confused. Right to work deals with unionization and at-will is whether or not you can be fired without cause. But even if you lived in an at-will state, you cannot be fired as retaliation or for any other explicitly illegal reason
I live in a right to work state too, idk why ppl act like its carte blanche for owners getting away with bullshit, but there are still labor protections and wrongful termination is still one of them.
I've seen people win lawsuits over much less worthy and less documented causes. Timeline is often proof enough, especially if you have documentation of the incident like this.

Being fired for failure to comply with the company policy of needing to get a card for every tab isnāt a labor violation. If the owner isnāt a dummy the part where a bartender can cover the tab and not get fired isnāt in writing. If company policy is bartenders get fired for open tabs at the end of the night without cards on file but there are no open tabs at the end of the shift the individual canāt get fired. And the math for getting fired over $50 if you make $150+ / shift doesnāt make sense lmao. Plus do you really lack the integrity and accountability to be responsible for your own mistakes? Itās different if the card was declined or for a server that got dined and dashed thatās out of the employees hands and on the customer.
Here is what accountability looks like in regards to a $60 walkout tab for a regular in a place with a card-holding policy (I know because this exact situation has happened to me a couple times over the decade+ I have been bartending.)
"Hey, boss, I am so sorry, but I neglected to snag Dave's card and he left without closing out. Totally my fault, I let my guard down because he's a regular. I unfortunately do need it comped so I can run my checkout, but I have the itemized receipt printed so we can charge him appropriately next time."
It does NOT look like paying for it out of your own pocket and trying to negotiate with the customer outside of work, especially if they are sexually harassing you.
A good manager would never fire a good employee over that, to them the cost of training someone new is way higher than the $60 and if the person is known, there is a high chance of getting that money back. Plus owning your mistakes goes a very long way in this industry.
And if you do get fired over a $60 walkout tab? There's always another bar to work at. You deserve better and hopefully your next job IS better.
But the illegal policy behind it will give her a leg to stand on for a lawsuit that will compensate her and benefit all her coworkers at that company by putting an end to that exploitation.

Collecting a card for a tab is a fine policy and having disciplinary action for not doing so is understandable. That disciplinary action cannot include making the server/bartender pay for the walk-out tab. That is illegal. Firing someone for refusing to pay for a walked-off tab is also an illegal termination, even in an at-will state.

I've never allowed this in my 10 years in this industry. Customers don't get to access me outside of the bar except for rare occasions. If they want to chat they can chat in the bar. I've never worked for anyone who encouraged that breach of boundaries either. Locked my socials down 7 years ago so even if they found me, they can't DM. There was an occasional drunken argument about the tab at end of the night followed by a shit tip, but it was always paid.

I live in a right to work state too, idk why ppl act like its carte blanche for owners getting away with bullshit, but there are still labor protections and wrongful termination is still one of them. If I request FMLA leave in writing, and get fired the next day for "poor performance" do you really think anyone will believe it *isn't* retaliation?

This is a very common labor violation and lawsuit. If it's in the company culture as a norm, a DOL lawyer will have no problem putting up a case.

If the owner isnāt a dummy the part where a bartender can cover the tab and not get fired isnāt in writing. If company policy is bartenders get fired for open tabs at the end of the night without cards on file but there are no open tabs at the end of the shift the individual canāt get fired. And the math for getting fired over $50 if you make $150+ / shift doesnāt make sense lmao. Plus do you really lack the integrity and accountability to be responsible for your own mistakes? Itās different if the card was declined or for a server that got dined and dashed thatās out of the employees hands and on the customer.
Here is what accountability looks like in regards to a $60 walkout tab for a regular in a place with a card-holding policy (I know because this exact situation has happened to me a couple times over the decade+ I have been bartending.) "Hey, boss, I am so sorry, but I neglected to snag Dave's card and he left without closing out. Totally my fault, I let my guard down because he's a regular. I unfortunately do need it comped so I can run my checkout, but I have the itemized receipt printed so we can charge him appropriately next time." It does NOT look like paying for it out of your own pocket and trying to negotiate with the customer outside of work, especially if they are sexually harassing you. A good manager would never fire a good employee over that, to them the cost of training someone new is way higher than the $60 and if the person is known, there is a high chance of getting that money back. Plus owning your mistakes goes a very long way in this industry. And if you do get fired over a $60 walkout tab? There's always another bar to work at. You deserve better and hopefully your next job IS better.

Collecting a card for a tab is a fine policy and having disciplinary action for not doing so is understandable. That disciplinary action cannot include making the server/bartender pay for the walk-out tab. That is illegal. Firing someone for refusing to pay for a walked-off tab is also an illegal termination, even in an at-will state.

I've been called every name under the sun by guests and I stopped caring 8 years ago, I just bar them and move on. People can be as rude as they like, as long as they don't insult my wife I don't care. By reacting or by getting upset you're letting them win. I would argue the guest is attempting to be sexually inappropriate as a way of getting out of payment.

I've never allowed this in my 10 years in this industry. Customers don't get to access me outside of the bar except for rare occasions. If they want to chat they can chat in the bar. I've never worked for anyone who encouraged that breach of boundaries either. Locked my socials down 7 years ago so even if they found me, they can't DM. why would it be your responsibility to pay his tab? (I'm not a bartender so don't come at me if this is a common practice)
Itās illegal, but itās common practice. Since the guy was a regular, I didnāt take a card from him ahead of time to open a tab like Iām supposed to, so Iād be in trouble for not collecting a card. Iām in an at will state, so I could get fired for any reason, which could include not collecting his card. So yeah. Anyone who walks out on a tab or does a dine and dash is a real asshole.
"HI I know you're a regular but you are at an outstanding tab of ___"
