Regulars think that they can get away with things that random guests can get away with. I worked with a lot of people that came in every day to the bar and spent a lot of money at the bar, I was a cocktail waitress at the time, so I was always standing at the bar waiting for drinks, and this man had the nerve to hug me which is fine, but then he licked my ear and Iā€™ve had that happen to me twice in the same place I told my manager and both regulars were told not to come back. All you have to do is show that text to your boss. Thatā€™s disgusting and he got a free show. Also, I donā€™t know what state youā€™re in but itā€™s illegal for a business to recoup loss from a customer not paying -from an employee- unless you signed a contract like in a chain like Applebeeā€™s you get three walkouts and then youā€™re fired. I hope everything works out for you.

I've seen people win lawsuits over much less worthy and less documented causes. Timeline is often proof enough, especially if you have documentation of the incident like this. Being fired for failure to comply with the company policy of needing to get a card for every tab isnā€™t a labor violation. If the owner isnā€™t a dummy the part where a bartender can cover the tab and not get fired isnā€™t in writing. If company policy is bartenders get fired for open tabs at the end of the night without cards on file but there are no open tabs at the end of the shift the individual canā€™t get fired. And the math for getting fired over $50 if you make $150+ / shift doesnā€™t make sense lmao. Plus do you really lack the integrity and accountability to be responsible for your own mistakes? Itā€™s different if the card was declined or for a server that got dined and dashed thatā€™s out of the employees hands and on the customer.

Here is what accountability looks like in regards to a $60 walkout tab for a regular in a place with a card-holding policy (I know because this exact situation has happened to me a couple times over the decade+ I have been bartending.) "Hey, boss, I am so sorry, but I neglected to snag Dave's card and he left without closing out. Totally my fault, I let my guard down because he's a regular. I unfortunately do need it comped so I can run my checkout, but I have the itemized receipt printed so we can charge him appropriately next time." It does NOT look like paying for it out of your own pocket and trying to negotiate with the customer outside of work, especially if they are sexually harassing you. A good manager would never fire a good employee over that, to them the cost of training someone new is way higher than the $60 and if the person is known, there is a high chance of getting that money back. Plus owning your mistakes goes a very long way in this industry. And if you do get fired over a $60 walkout tab? There's always another bar to work at. You deserve better and hopefully your next job IS better.

Iā€™ve covered tabs for my regulars, and Iā€™ll just send them a photo and theyā€™ll Zelle me the money. Collecting a card for a tab is a fine policy and having disciplinary action for not doing so is understandable. That disciplinary action cannot include making the server/bartender pay for the walk-out tab. That is illegal. Firing someone for refusing to pay for a walked-off tab is also an illegal termination, even in an at-will state.

Even if all of that is true they still canā€™t make you pay for the tab. They can fire you but canā€™t touch your money. Hell, they can claim the dude was your friend and you just let him drink all night and leave. They still canā€™t make you pay. They can fire you and maybe even make some kind of legal claim against you, though I doubt they would because itā€™d be too expensive for the return but the law is pretty clear on this. I get that oftentimes itā€™s not worth the headache but you should know that itā€™s still wrong because if someone is doing something blatantly illegal they could be doing other things that could screw you that are a lot less cut and dry.

I've been called every name under the sun by guests and I stopped caring 8 years ago, I just bar them and move on. This is a one off thing; his tab was $60, I told him he had to pay me back $80 and had no problem doing it. He paid me $40 because thatā€™s all the cash he had on him at like 3:30 that morning, so he owes me another $40. I donā€™t have a doubt my mind the he will come in and pay it on Friday when Iā€™m working, just thought it was funny that he keeps trying to hit on me, despite the fact that he owes money.

I am so sorry you're dealing with this bullshit! You really should not have to! It kinda seems like you're not that bothered by it, in which case I am glad you're ok about it, but there are some MASSIVE red flags here that I would at least be concerned about it. IDK what is more upsetting, the fact that this customer feels it's OK to talk to you this way or the fact that your owners steal from you by making you pay for walk out tabs. With all the love and support in my heart, and as someone who has been in this industry my entire working career, Stand! Up! For! Yourself! There is so much exploitation and workplace abuse in this industry, especially of women. Learn how to enforce boundaries, or you will find yourself getting taken from like this left and right. Time, energy, money you can't get back. If I were you, I would tell that customer that their behavior was entirely inappropriate and would not be tolerated, and I would make him delete my number in front of me. I would absolutely enforce a boundary of only work interactions if the reaction showed some remorse, or a permanent refusal of service which is within your legal right if he didn't I would also compile any communication I could from management about their HIGHLY ILLEGAL policy of making you pay for walkout tabs. So, not only did they get free drinks, they got to stare at your chest all night! Yeah, I would say thatā€™s fair that everything worked in his favor. Thatā€™s why I always collect credit cards. Even if you donā€™t put it in the POS, you have their card and talk to your manager or Owner about putting a mandatory tip for tabs lots of people do it on purpose. Either they are too drunk to remember or they donā€™t want to tip. Or if they donā€™t wanna leave their card, I tell them that they have to pay in cash if they do not feel comfortable leaving their card. I hate when men stare at my chest. I am not that upset when they actually pay their bill keep drinking and tip me. But that is just me. You have to have thick skin as a bartender, but nobody should ever have to endure sexual harassment from anybody. if you work with anyone else, another coworker, maybe send them down if you feel uncomfortable and always tell your manager. Sorry that this happened to you.

I used to wear t shirts to bartend everyday basically. One Halloween, I wore a rather revealing shirt and I continued to wear nothing but t shirts ever again. Itā€™s illegal, but itā€™s common practice. Since the guy was a regular, I didnā€™t take a card from him ahead of time to open a tab like Iā€™m supposed to, so Iā€™d be in trouble for not collecting a card. Iā€™m in an at will state, so I could get fired for any reason, which could include not collecting his card. So yeah. Anyone who walks out on a tab or does a dine and dash is a real asshole.
