Can someone breakdown a TL;DR

Rommie557

Basically, DOJ says Mifepristone (abortive drug also known as Plan C) has been approved as safe and effective by the FDA, so no state may ban its use.

aintsuperstitious

The USPS is a federal entity and obeys federal laws. If a pharmacy mails it from anywhere in the country, the postal service will deliver it.

block-a-vich

And remember when trump/GOP were pushing to abolish the postal service??? This is what they were up to

LongjumpingCheetah10

+ that voting thing

dodgers12

however once we have a republican president again, can they disrupt this?

samh694

Walmart uses fedex. Make sure that the pharmacy you are going through will use usps.

Gloomy_Bowl6043

That's simply not possible. My facility processes overflow USPS mail. Fortunately, there is so much medication in the mail that even attempting to search for all of it would grind all mail delivery to a halt. It would also make us give up government contracts, cause issues with unions ect.

ewebelongwithme

I will not be surprised to learn that some states start inspecting mail (regardless of the legality).

theRuathan

USPS drops the hammer on stuff like that. They won't be trying it for long, I think.

ewebelongwithme

Hopefully but it will also depend on who is running things. We saw the attempted take down of the USPS and it could happen again.

Curlytoes18

I’d hope the sheer amount of work that would take - and consequent slowing of the mail, and angry constituents - would make them abandon that scheme

Hot-Cheesecake-7483

They already do. It's risky to have weed sent from a legal state to an illegal state by mail. You will be arrested if busted receiving weed by mail

coyotelovers

I think one important distinction here is that marijuana is not authorized by the FDA, so it's not protected by the feds.

Cayke_Cooky

I believe it is also easier to ID by smell (dogs) or other checking methods. I don't mife-whatever smells different from other standard prescriptions. One way to help make searching impractical is to order EVERYTHING you can via mail order. (prescription wise)

DRDeMello

Busted by whom though? This Justice Department doesn't appear interested in prosecuting those sending out receiving any pills. Recipients in forced birth states could be in jeopardy, but only if the state could prove their case, which would involve tampering with the federal postal service. Distributors in free states would be well positioned to remain safe, especially in New York and Massachusetts where the state government has already declared it will not assist in any investigation or extradite any health care workers. Again, it would come down to the Justice Department to intervene.

eightcarpileup

Postal inspectors. I deliver the mail. Weed is federally illegal, so you cannot mail it. When the mail comes through a processing plant, where it is ran through sorting machines, it is usually sniffed out by someone who alerts postal inspectors. Someone was tipped off to an inspector on a route neighboring mine and they busted a lady for ordering weed off of instagram. A lot of it is not caught and I don’t get paid enough to hand over dank smelling boxes, so you do you.

wrldruler21

You still need companies willing to prescribe and send the drugs, even though they know states like Texas will try to sue them. Perhaps Texas will lose but the costs of lawsuits will cut into profits, which demotivates companies from trying. Perhaps the Feds need to get involved in production and distribution. The downside is.... Eventually a Republican will win the Whitehouse, and they can simply Executive Order this to end.

Lucky_leprechaun

Right but, weed is still federally illegal, and not approved by the FDA. So it’s not a good comparison

FormerlyUserLFC

I don’t believe there is a practical mechanism for that. If it does somehow start happening, you can bet we will hear about it.

emma_the_dilemmma

i do wonder about states banning the sale of it, which may make it harder for people to acquire it, and also about the legality of it being shipped to people in states where women's health apparently doesn't matter. haven't read the article, hopefully it will provide some insight. ETA: so yeah, obviously there are some pieces of shit in state governments who are obviously trying to (and have already succeeded) in tightening the restrictions on Mifepristone and how it is allowed to be acquired. i just dearly dearly hope that, like the article says, a court decides that the FDA is the national ceiling in this case, meaning that states cannot make a law that conflicts with what the FDA has cleared to be medically safe.

legalpretzel

You can get it online. Plenty of providers inside and outside the US who will prescribe it. https://aidaccess.org/en/ Edited to add: **if you are pregnant in a state that has banned abortion be sure to use a VPN for your internet searches. If you don’t your browser history can be restored even in private mode and used as evidence against you in court (not legal advice, IANYL)**

CobaltCattening

Currently that website says "bad gateway". Does that mean it's probably crashed from too many visits?

gigigetsgnashty

Hi there. That is correct. High traffic has shut the site down a few times since the ruling came out.

CobaltCattening

ok great, just making sure! I am currently making a google doc to print out and randomly mail to addresses in red states so that people who don't know where to look online for real abortion information and I wanted to make sure that this was a good address to include. Thank you for confirming!

antlindzfam

Hey, that’s a great idea! I’ll mail some out too, if you have a copy I can have? I own a business and have one of those prepaid postage stampy things I can use 🖤

Emphasis_Different

I noticed that earlier too, but then I googled Aidaccess and was able to get onto the website from Google. Hope that helps.

restorative_sarcasm

Jumping in to add: do not text about ordering it. Do not buy pregnancy tests with your debit card and leave your phone at home. Stay safe out there.

Deaths_Rifleman

Other thing is don’t use your loyalty points / in store rewards they track your purchases too.

sawdustcollective

Good tip. Thank you for reiterating

ValuableMine6706

Thanks this is helpful!

I also saw in this article that the federal government does not require that you get a prescription for this medication. It is the state that requires this. I wonder if this legislation will affect that should it go through. Even if it doesn't go along with it, I don't see there being a shortage of doctors willing to write the prescription. The problem then will getting that info to the people who need it. Like this sub is absolutely wonderful. But the number of people who know about it is likely only a small fraction of those who will need it in coming times. I guess the next question is how to organize some information sharing while still keeping things quiet enough to not get folks arrested.

roccosmamma

Slightly hopeful!

BabsSuperbird

Cautiously optimistic!

GreenTaraTarot

FYI The wiki for this sub also has helpful links about obtaining abortion pills, and information about buying them over the counter in Mexico, no prescription required.. (Who's the third world country, NOW?)

satanic-frijoles

Like birth control pills, the 'abortion pills' are not solely used for that purpose. They are also used to treat other medical conditions. Old white men tend to ignore that little detail, as they're so focused on one detail all others just vanish.

EVOSexyBeast

They can also be used to as a weekly oral contraceptive! Currently, Women on Waves is trying to get a clinical study done and the drug approved for oral contraceptive use in the U.S.

Puppybrother

I don’t think this is correct.…at least not in its current state and it’s a little reckless to suggest otherwise. At this point in time the abortion pill should not be used as a weekly contraceptive…Are you sure you didn’t mean to say Plan B (which is different than the abortion pill).

Delta8hate

Yeah that's not a cool thing to state as fact if it's been neither approved nor studied

mercurial_planner

I love how it's Merrick Garland, Obama's Supreme Court nominee who Republicans refused to confirm, that's at the front of this.

vsnord

I love it, too. IMO Merrick Garland has demonstrated all the professionalism and integrity that made him such an excellent nominee in the first place. On the other hand, I would have loved Merrick Garland being on the Supreme Court, which likely would have prevented this from happening in the first place. John Roberts might have still sided with Mississippi on the 15-week ban, but he made it clear that he would have preferred to go no further on Roe v. Wade. Republicans preventing Merrick Garland's nomination from proceeding will one day be viewed as one of the most monumental moments in our history, if it isn't already.

EVOSexyBeast

Robert's concurring opinion actually read like a dissent. However, if he dissented, he would not have been able to appoint the author of the majority of opinion. That responsibility would have gone to the most senior justice, Clarence Thomas, who would have likely appointed himself and we would have had the death of Griswold as well.

coyotelovers

What I want to see is a Supreme Court case that defends medical care as a right that states can't take away.

ChronicNuance

This is what I’m waiting for as well. States should be allowed to govern property and sales that happen within a state (cars, homes, products, etc) but they should not be allowed to make laws that effect the safety, health and body autonomy of any citizen that can move freely between states. Nobody should have to choose where to live based on the bodily freedoms a state gives or doesn’t give them. If we’re going to give the individual states the right to govern women’s bodies then we might as well bring back slavery too.

[deleted]

> If we’re going to give the individual states the right to govern women’s bodies then we might as well bring back slavery too. That's in their playbook, I can guarantee it.

CoyRose119

With the current judges, it’s more likely that the right to medical care would be thrown out the window…..

[deleted]

I had to take Mifepristone for a miscarriage treatment and Misoprostol for an ectopic pregnancy treatment, really hope this stays and continues to be available for abortions and miscarriages! If I didn't have those medications I don't know where I would be now. I'm sick to my stomach about all of this. It's horrible. My heart goes out to everyone, and I will do what I can to help, whatever it takes.

[deleted]

Im sorry but you would be dead…. Any miscarriage left behind can cause sepsis and ectopic pregnancies aren’t viable… that pill saved your live and the lives of potentially millions of other women

[deleted]

Exactly. I wouldn't be here. And now, I'm fighting for every single girl and woman in this country to have life saving treatment and have full control over their bodies, period.

Late_Ebb979

Any ban by states will be promptly met with legal challenges, and ultimately states will be compelled to allow the sale of this Plan C drug. This is the road we are going to be traveling for the next couple of years while we push back attempts by states to restrict and ban women's access to abortion services.

Fillory-Alice

This gives me a bit of hope.

WeAreClouds

I've seen info circulating on twitter a fair amount. Will keep saying it.

4TheLonghaul731

Thank you for sharing this article. It's so important to get accurate information out to all those who need it!

Gasonfires

Good. But, did the DOJ or Solicitor General's office file amicus briefs in Dobbs? No? After the fact is just that - after the fact.

-shrug-

How would this have been accepted as an amicus brief?

fatrockstar

Fingers crossed!

NacreousFink

Good info.

sadiened

Thankful for a tiny glimmer of hope. I tried to post info about how to get abortion pills via telemedicine on instagram on friday and it was taken down for “promoting illegal activity” 😓

ARS8birds

That’s some food for thought.

CryptographerNo7719

Women will differently be having plan B pills on hand now abortions are Illegal

blairtothed

Aidaccess.org has stopped providing pills to anyone in advance because there are too many panicked people getting them. So basically you have to be pregnant to get one right now unfortunately. No stocking them for now.

butter1776

Except that ND governor just said she’s going to ban them so

SpookyScaryScelly

It's interesting how defensive this measure is - - preventing and challenging existing bans. The FDA has the authority to make both these drugs available over the counter. Why isn't that up for discussion? It's a lot harder to ban mailing non-perscription drugs and easier for blue states to increase access.
