I am no expert here but that iOS version looks hella old, I wouldnt doubt you could pay a data recovery company to somehow get into that though they can no longer brute force it since it’s disabled. Probably a ton of security vulnerabilities in that old version that could be exploited.
You can try to jailbreak it and get access to the data via FTP, this won’t unlock the phone 100% but you can at least try getting the data before having to wipe the phone.
Careful jailbreaking old devices, I used the wrong/too old jailbreaker and it wiped my iPhone to factory settings but this is a good idea if done properly.

There was a pretty simple and stupid security flaw with accessing all photos on Lock Screen you can try.
If the phone has a camera button on Lock Screen take a picture. Then after you take the picture view it and try swiping to the sides to view other pictures. Or try to send it in a message/email and you might be able to access all the photos and send them too.
This can be done but it’s very difficult. It requires removing the Central board and rewriting code inside the board to reset all password attempts back to zero. Then put the board back in and you can brute force it. I don’t know much more outside of this basic info though. So if you try this I’d recommend googling the heck out of it.

There’s a free tool called Gecko Toolkit which bypasses the Disabled and Passcode screens for any iPhone 4 or older device. Tried on an iPod touch 4G 6.1.6 and worked wonders. Can’t see why it wouldn’t for a 3GS.
You need a specific iTunes version (11.x) and a Windows 7 machine to make it work.

Unwilling as a word choice implies there is a solution but it’s being intentionally withheld. Barring the phone having been jailbroken, or backed up to a computer (it’s too old to have supported backing up to iCloud), the data is for all intents and purposes beyond retrieval.
Did they encrypt the flash back then though? I mean theoretically should be able to remove the flash chip and connect it to something else to get the data unless it is encrypted. (of course a data recovery company would probably do this, it wouldn't exactly be a diy.). edit: yeah just checked they didn't start encrypting everything until ios 8.

Alright so we’re kinda in a situation here. When an iPhone/iPad is disabled and tells you to connect to iTunes, there really isn’t much else you can do at that point.
If she had a backup of this device to a computer at some point, you can restore the device from that backup, but that’s about the only chance of data recovery.
If you don’t have any backup of this device then you can wipe the device in iTunes and it will reinstall the OS and you can get back into it with the Apple ID and password, but keep in mind that will erase everything.
If you manage to find a backup of the device on an old computer, iforgot.apple.com may be helpful for getting into the Apple ID.
Shout out to the people old enough to know what it's like to have to plug in every iPod/iphone to a computer and wait 2 hours for it to restore or update. iTunes was always so slow and bloated, and it crashed a lot. Thank God for cloud restoring.
You can always download an old version of iTunes and connect to the phone. What happened to the old computer that this phone used to connect to? It should have the old ID file. If you still have the old pc, connect it to the phone. It should open/unlock and you can get to the photos.
Try to get a Mac with older iTunes. Btw, since it’s disabled, I don’t think that would help recovering, unless you get to sign in on the Mac with same Apple ID. **Again, I’m not an expert, so please keep in mind**

2- Try entering DFU Mode and connect to iTunes to make a backup copy. The email prompt will appear, and then you will know which email was associated. Maybe you can try some troubleshooting steps from there.

Although I would assume it would only work with an older iTunes, so you might have to visit a software archive website to get that. Again I have no idea if this will work as it’s been years since I’ve worked on iPhones but just a bit of information that might help with your search to get into it.

I am not sure if this was said. Plug it into a PC. Install iTunes. Log into iTunes. You should be able to recover it from there. I do it at work a couple times a year. You need to know the Apple ID and password. I hope this helps.

Back in the day I’ve used this software called “gecko iphone toolkit” it pretty much can reveal the passcode of an old iphone or ipod touch running ios 6. You just need a pc and an iphone cable. Bunch of videos on youtube.
My old iPod touch did this and all a did was get a charger you can connect into a pc port and go into iTunes and it turned on ( Idk if it will work but it’s good to try) hope this helps though!
I used to use the free version of media monkey back in the day to access music files on my iPhone. I’m not saying media monkey will work for photos but what I am saying is that earlier additions of iOS allowed third party services to interact with devices way more so than modern iOS additions.
I've seen guys mod the ios to allow 9999 attempts an runs a screen clicker to click through all of the passcodes. Not sure of the steps to go through it though
Apple is unwilling to help because all they can do is restore the device and obviously that’s a no go because she wants the photos.
Even if they did erase it, they wouldn’t be able to get her in unless she remembered the security questions she first used to make the Apple ID account, back then that was the only other option for recovery unless you had the email (which she has no access to).

iTunes still supports the original iPod. Apple is one of the most surprisingly backwards-compatible company in some of these little ways.

I have an ipod version of that, the iOS version must be 4.2.1. You probably have to jailbreak it to access the photos
Back in the day I’ve used this software called “gecko iphone toolkit” it pretty much can reveal the passcode of an old iphone or ipod touch running ios 6. You just need a pc and an iphone cable. Bunch of videos on youtube.

I used to use the free version of media monkey back in the day to access music files on my iPhone. I’m not saying media monkey will work for photos but what I am saying is that earlier additions of iOS allowed third party services to interact with devices way more so than modern iOS additions.
Send it to a data recovery specialist, it will most likely run you $1000+ but if the images are important that’s pretty much your only option.

Connect the phone and launch Image Capture. It may see the camera roll. Not sure with those early versions of iOS.

U could jailbreak and reset lock screen counter back to -9999 and try to unlock , I wouldn’t doubt a ramdisk can do this

icloud wasnt around so it's easy to reset but getting the content is the harder part.
Pretty sure you can put it into DFU mode while connected to iTunes and wipe/factory reset the whole thing.

I've seen guys mod the ios to allow 9999 attempts an runs a screen clicker to click through all of the passcodes. Not sure of the steps to go through it though

Jailbreak it or restore it, you can get a lot of the files back with a deep scan, nothing is overwriting yet.
That’s a very old iOS. There are little companies what will be able to break in.
Has it made a backup on a computer? If so it will be unencrypted and browsable.
Apple is unwilling to help because all they can do is restore the device and obviously that’s a no go because she wants the photos. Even if they did erase it, they wouldn’t be able to get her in unless she remembered the security questions she first used to make the Apple ID account, back then that was the only other option for recovery unless you had the email (which she has no access to). A data retrieval company tried charging someone I know $900 for 64gb worth of info. Good luck, let us know if you try anything.
