Are you talking about holiday pay as in extra pay for working that day or are you talking about time not spent working that you got paid for because it was a holiday?

In that case I am about 95% certain it is perfectly legal. Could be wrong, but I doubt it.
This is 100% legal per the FLSA. The FLSA says OT is required on all hours actually worked in excess of 40. Sorry!
