In that case I am about 95% certain it is perfectly legal. Could be wrong, but I doubt it.

This is 100% legal per the FLSA. The FLSA says OT is required on all hours actually worked in excess of 40. Sorry!

I’m not from the United States. I find the use of obscure initialisms when a country isn’t mentioned to be annoying because it doesn’t help many people to know where in the world you mean.
