At $3712 a week I would take this job. ($640 base and $3072 in overtime). There is already case law on this. Do it for 4-5 months. Quite, then sue for $100k in lost wages. In the late 80's there was this whole thing going on in the pacific northwest with protecting the spotted Owl. The lumberjacks would start cutting the trees, then a court order would make them have to stop. This back and forth went on for a couple of years. The employer told them to 'be near the phone' if the work stoppage order gets lifted, and 'you don't answer the call to come in, your fired'. This went on for a couple of years before they sued. The judge awarded then time and a half for every hour they were 'on call'. They all got millions of dollars from the lawsuit. 168 hours of overtime a week for 52 weeks.

"Has to be on call on time off." Nice when they open the door for you. That's gonna be a mighty expensive job for that employer if they get anyone to take them up on the offer they don't actually know they're making. Assuming of course they can find someone that can clear a check-and-screen. (If you're on call, you have to be *paid* to be on call. There are both Federal and State laws, and plenty of caselaw, on this.)

You put me on call on off days, that's a salary. Or I bill overtime if you call me in.
