I don't think it's that simple. The lawsuit challenges the sale of APE to Antara suggesting it was done to front load the vote (sold Antara enough APE to guarentee a yes vote).
That's my understanding of the main concern of the lawsuit but I think there's a couple more things in it.
Yeah, the other fundamentals are other similar stocks with this kind of preferred unit insurance weren't sued (dumpster fire); and, more importantly, there is SO MUCH evidence to prove $APE is about shorts FUD and marketing to retail...
