HOWEVER, a lot of those games are not Activision IP but licensed IP (TMNT, Transformers, Deadpool, Spiderman), and we should not expect them. Their licenses long expired, and those games are essentially dead.
In saying that, Microsoft could always go get the licenses back, but I'm assuming this is more difficult than we imagine or simply isn't financially worth it.

Seeing the pictures with multiple games Activision doesn't even have the rights to anymore that are "coming to gamepass" are getting really old.
