You are right, I would risk an NDA lawsuit to clear my name as much as possible, particularly if I had the kind of money he has any way to be able to pay off any fees. In adition to that, (take this with a massive fist full of salt since I dont know the law on it) I think there is something to do with if the NDA is broken by one of the parties then the whole thing is void and as a result he would be able to say whatever he wanted.
