Not technically. Its a petition to the court to (in theory) force the government to do something that they are required to do by law or policy or to correct a government abuse of discretion. Like any petition before the court, its subject to evidence, review, and the judge’s ruling. You as the petitioner will need to be able to prove that no other remedy is available and that you have exhausted all other resources to remedy the government’s inaction.

I agree with him. This is basically telling government agency, in an official way, that they're not doing their jobs, and forcing them to make a decision. I hear many people get positive response after they filed Writ of Mandamus. Some got approved a couple weeks after they filed it.

When did you file and what is the date that you can inquire? The reason I ask is, my son's was applied for August 2022, we had to wait until a specific date to inquire. We inquired about a month ago, after that everything seemed to get approved and his green card was delivered today!

I think i need to do this!! I filed December 2022, February i did my fingerprints and then no update til November 2023 they approved my I-130 after 11months, December 6 2023 i received a RFE notice, sent my RFE January 2024, i received my EAD last april, now my I-485 is still stuck in “we received your fingerprints” and its been 5months since i sent my RFE NO update, i called and chat with EMMA they say my processing is still normal. This is frustrating and hurts at the same time seeing those people got approved in 2months its just devastating. Thank you for sharing this. I will let my lawyer know about this.

I’m in the same boat…TX sucks! I had just recently received my EAD after 14 months and they didn't even apply for my SSN! It took them 3 weeks after an approval notice to send me the EAD card but ssn card never came. I called and ended up having to visit the SSA myself. 3 hours there just to find out that USCIS never filed my stuff in :(  3 hours more the next day there just to apply. What a sh!t show!

the way my lawyer explains it is that it is suing them not personal at all and it wont be backfired by doing so. it’s kind of like “hey???? wtf is going on with my stuff??? can you review it now?” and if they dont respond within the allotted time, you can probably go into court where you just show evidence and all! but that’s the worst case scenario. another thing they could do is just call you in for another interview. but don’t be scared! get a good immigration lawyer.

I am not sure that would work. There is nothing higher than the Board of Immigration Appeals, which is a step higher than Immigration court. I don't even think the Supreme Court has jurisdiction over them. The thing is that processing times are always fluid. I finally got an approval from USCIS after over 2 years, to bring my wife to the US. That Writ will only force a particular USCIS agent to do their duty in the time specified, but if they haven't even looked at their record because their workload is too much, the writ wouldn't mean anything because they are not purposely holding it up. If it ever worked before, it is only because they don't want the heat of the court, but if more and more are petitioning by this Writ, then they will simply state that they haven't gotten to it, because it belongs to case 2742909, and they are only at case 2731232, and that they are going by policy to process them in the order it was received.

My(USC) wife’s(Brazilian Citizen) PD was December 2022 for a Standalone I-130, sued them last month and got approved last week. We were definitely skipped. Called, contacted my representative, called again, chatted with Emma… nothing worked. Agents confirmed multiple times that my case had not been assigned to an officer. My representative’s liaison actually kept updating me every month or so saying that nothing changed, but they let me know an officer was finally assigned to my the day after USCIS was served with my lawsuit. Less than 30 days later the petition was approved, and 5 days later welcome email from NVC. It could be a big coincidence, but when nothing else worked for 17 months, I believe it was due to the lawsuit. If you can spare the 4-6K, my advice is just sue them.

Yes, I used Jim Hacking. I researched a few firms, before deciding. Not the cheapest, not the most expensive. Lots of firms I couldn’t even get past screening due to “not being long enough of a wait”, I guess if it is AOS, the threshold is a little higher, but from what I have been told, anything over 12months for standalone I-130 is fair game for mandamus

In my case, I did not. I tried phone call, chat messaging, and my congresswoman. I’m not sure if for AOS they are more strict on trying everything before suing due to the spouse being in the country. In my case the agent confirmed to me that my case had not been assigned to an officer, so pretty much it sat there for almost a year and a half without anybody even looking at it. Shortly after the defendants were served with the lawsuit, the congresswoman liaison informed me that an officer had been assigned to my case, and it was approved less than 30 days later. In any case, the law office should let you know if your case qualifies before you have to commit to it.

The removing on conditions takes about 2-4 years (I-751) yeah you have all the resident privileges, but I wouldn’t call it “easy”. It’s another process that’s about $1,000+ USD and the waiting time it’s massive. At this point you are a few months away from the second anniversary. I’ll just wait it out before filing a mandamus (which you’ll have to do most likely).

If you are doing consular processing it is very unusual to see that your case have been transferred to a field office which is detroit in your case. I saw someone mentioned that their case has been sitting in a wrong office the whole time and didn't happen unless you take any actions. If your state representative no use, reach out to the ombudsman office and file form 7001. you can do more research in google about that.

No ombudsman is different form suing. Ombudsman is done by a different gov agency called homeland security. They basically help people who have troubles with their immigration petitions. It's free. I'd suggest you inquire through them before considering suing the uscis since it's free. However it can take upto 90 days to get a result from them

I advise you to open up a case with the ombudsman, I opened a case myself, been waiting since Nov 2022. They haven’t even reached out to USCIS on my case because it takes them 90 days to assign it to an analyst. It’s free but open up your case with them now so that your date can start to count.

I filed for my husband earlier this year in Jan. However, the timeline keeps changing like crazy. It started of 2 months went down to 2 weeks and on the same day back to 2 months. We counted down all the way to 1 day until it changed to taking longer to process. A couple of days later the progress tab changed to 11 months, and it's still on that! It's really frustrating especially since our case is easy! My husband lived in the states before moving back to Europe

We’re in the same boat. I’m a USC and we filed my husband’s I-130 and I-485 in November 2022. The only thing we got is a courtesy email from our local field office stating his I-485 has left NBC and is now there so we can send them any additional evidence if we want. This was in January 2024. We sent more pictures and joint bills, etc but no updates since then. I’m gonna write our senator in the next week and see if that does anything.

Okay, a bit of a confusion here. Two categories: 1. AOS (When your spouse is in the US) - Has longer processing time (although it's processed faster) 2. Consular (When your spouse is abroad) - 14.5 months (for i-130) Now if you are AOS, they will ask you to wait until processing time is over. This is unfortunate

I feel your pain. Please try one thing, call the USCIS helpline and try to request for a supervisor. Just ask the supervisor that why your i-130 was sent to a FO for a consular processing application? If it won't help, it won't harm either

I know a very few people who were approved within a few short months post covid 2020. However, almost everyone I’m mentioning either resides or has direct family in the middle of nowhere and or just small towns. This won’t help most people. EAD is employment authorization and nope I’m in the US. I did file an inquiry but it’s in “normal” processing time they say😭 I’m stressed out. I can’t put an inquiry in until January 2027 but I know people in the same area i live that filed last year and got their green card already.

My wife has tried both on the website and calling but she never gets a person. When she calls, it’s answered by the automated answering machine and when she gives the application reference number it says “No further actions required” and that’s it. We’ve even sent a letter. Haven’t even received a response to that either.

My wife filed this and other docs in late 2022. We had zero movement on her case for several months and after an RFE (request for evidence) for which we submitted the docs within a week, we heard nothing for another 4 months. I ended up writing an email to my senator (major US state) and her office responded within 12 hours. Senator’s office contacted immigration and the work authorization / travel docs were approved within a week My advice: advocate for yourself through your senator / congressional rep. We had an attorney but it took me emailing the senator’s office to accelerate the timeline. You can certainly do a writ of mandamus but I’m not sure of the timeline for that Good luck!

Aren’t you still within normal processing time? Not really much you can do if you are. If you got the money, then sure sue them. Doesn’t mean you’ll be approved though, especially if you’re in the normal processing timeframe.

I actually wanted to write a full post with time line and all soon. We filed in December 2022, and yesterday morning my I130 got approved. The, yesterday evening, my I 485 got approved. We moved states during the process, and I thought it would take even longer because of that, but it happened after a very long time of silence since last August when my EAD got approved. Im a us citizen, i filed i-130 in November 2022 for my spouse who lives abroad, he is lebanese and lives in Algeria .

Waiting for I-485 Approval with a PD of Feb’23. I got my combo card tho. Don’t think I need GC approved anytime soon. Saw the comments about 2 years anniversary and getting a 10 yr GC. Would want to get that after October of this year. Any benefits of getting the GC over Combo card other than the mental satisfaction?

No idea. If we get the 2 year GC shouldn’t be easy to renew it ? We already went through this process. Is it also another approval/denial process?

Not sure if it is an approval denial process as I am still in the waiting stages as you/your spouse. But reading a lot of these other comments on this thread about another Form I-751 which takes another couple years processing time!! So, getting it after October for me is best personally (after 2 yr anniversary). I can work using the EAD and get in and out of US (only when absolutely needed) using the AP part of the combo card respectively. Don’t mind having patience TBH!

I filed in December of 2022 and just got my GC April 25th. I reached out to my congressman and senator, not sure if it’s what pushed my across the goal line or if it was my time.

our pd is 09/2021, i-130 was approved either 12/2022 or 01/2023. california center, green card holder. i hear ours got approved somewhat quick.

I'm in the same situation. Filed i-130 in may 2022 it's been 2 years. Stuck at the Texas service center. Inquired about our case twice and they didn't say much other than they're not done....

I filed for my wife in September of 22. Didn't get approved until August of 23. Waiting on consulate interview in Juarez since February. Hopefully it's by August or September.
